RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04852 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect his grade and pay as a Technical Sergeant (TSgt) E-6 rather than Sergeant (Sgt) E-4. APPLICANT CONTENDS THAT: He served his country with honor for over 20 years and regrets making a big mistake that reflects on him and his family. He wanted to stay in the service but was not provided an opportunity for rehabilitation. He has tried on several occasions without success to have his DD Form 214 corrected. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 9 Apr 64, the applicant commenced his enlistment in the Regular Air Force. The applicant was tried and found guilty by court-martial for uttering checks in the amount of $1,100.00 between 24 Feb 86 and 14 Mar 86. He was sentenced to forfeiture (suspended), confinement, and a reduction in grade to E-4. On 16 Mar 87, the applicant applied for retirement. On 23 Sep 87, in accordance with Special Order AC-15652, he was released from active duty in the grade of Sgt on 30 Nov 87 and retired, effective 1 Dec 87. He was credited with 20 years and 10 days of active service. On 8 Oct 87, the Secretary of the Air Force determined the applicant had served satisfactorily in the higher grade of TSgt. On 15 Oct 87, Special Order AC–609, amended Special Order AC-15652 to reflect effective 21 Nov 97, the applicant was advanced to the grade of TSgt on the on the USAF Retired List. AIR FORCE EVALUATION: AFPC/DPSOR recommends denial indicating there is no evidence of an error or an injustice. The applicant’s DD Form 214 accurately reflects his active duty grade and pay. The governing directive, DODI 1336.01, Certificate of Release or Discharge from Active Duty (DD Form 214/5 Series), and AFI 36-3202, Separation Documents, or policy, do not authorize the entry of projected grades or advancement that have an effective date after the date range for which the DD Form 214 was prepared. His advancement under Title 10 was for the purpose of retired pay and benefits. The applicant has not provided any evidence showing his DD Form 214 was erroneous or not in compliance with the governing directives, policy or law. Lastly, the applicant was provided this information verbally and written in 2013. A complete copy of the AFPC/DPSOR evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 16 Jul 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
