RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04855 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1.  The “Given Under My Hand” date on his Meritorious Service Medal First Oak Leaf Cluster (MSM w/1OLC) be changed from 6 Nov 14 to 19 Dec 13. 2.  He be granted a Special Selection Board (SSB) for the Calendar Year 2014A Lieutenant Colonel Central Selection Board (CY14A Lt Col CSB), with his corrected MSM w/1OLC in his record. APPLICANT CONTENDS THAT: His MSM w/1OLC incorrectly covered only the period 4 Jul 12 through Sep 13, and stated it was awarded for achievement. The award has now been corrected to reflect it was awarded in conjunction with his permanent change of station (PCS) from Cannon AFB, NM and to cover his entire assignment from 4 Jul 10 through 15 Jun 13. However, the “Given Under My Hand” date on the corrected citation reflects 6 Nov 14 instead of the 19 Dec 13 date it was originally awarded. Due to the incorrect Nov 14 date, it cannot be included in the Special Selection Board he is requesting without first changing the date back to 19 Dec 13. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant served on active duty in the grade of major during the period of time in question. On 19 Dec 13, the applicant was awarded the MSM w/1OLC for Outstanding Service during the period 4 Jul 12 to 3 Sep 13. On 6 Nov 14, the applicant’s MSM w/1OLC was corrected to reflect that it was awarded for Meritorious Service during the period 4 Jul 10 through 15 Jun 13, but the “Given Under My Hand” date was inappropriately changed from 19 Dec 13 to read “6 Nov 14.” The remaining relevant facts pertaining to this application are described in the memoranda prepared by the Air Force offices of primary responsibility (OPR), which are included at Exhibits C and D. AIR FORCE EVALUATIONS: AFPC/DPSID recommends granting the requested change to his MSM w/1OLC, indicating there is evidence of an error or injustice. In accordance with Title 10 United States Code (USC) § 6249 decoration recommendations are to be submitted as soon as possible following the act, achievement or service. Other than the Purple Heart Medal, recommendations are to be entered into official channels within three years of the service performed, and awarded within five years. In this case, it appears an error exists through no fault of the applicant’s. The applicant should not be penalized because the original certificate was prepared in error. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. AFPC/DPSOO recommends granting the applicant an SSB for the CY14A Lt Col CSB, indicating there is evidence of an error or injustice. DPSID states when the applicant’s MSM w/1OLC was corrected to reflect the proper inclusive period of 4 Jul 10 through 15 Jun 13, the “Given Under My Hand” date was inappropriately changed to the date the correction was made rather than the date of the initial award. The applicant was not selected to the grade of Lt Col by the CY14A Lt Col CSB. The corrected MSM certificate should be filed in the applicant’s Officer Selection Record (OSR) and updated on his Officer Selection Brief (OSB), and then he should be granted an SSB for consideration by the CY14A Lt Col CSB. A complete copy of the AFPC/DPSOO evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS: Copies of the Air Force evaluations were forwarded to the applicant on 1 Apr 15, for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinions and recommendations of the Air Force offices of primary responsibility (OPRs) and adopt their rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected as follows: 1.  The Given Under My Hand Date on his Meritorious Service Medal First Oak Leaf Cluster (MSM w/1OLC) be changed to 19 December 2013. 2.  His corrected records be considered for promotion to the grade of lieutenant colonel by a Special Selection Board for the Calendar Year 2014A Lieutenant Colonel Central Selection Board.
