RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04957 COUNSEL: NONE HEARING DESIRED: NOT INDICATED APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be updated with the Air Force overseas long tour and longevity ribbons. APPLICANT CONTENDS THAT: He served overseas for 18 months in Newfoundland and was enlisted for four years. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 25 Jan 63, the applicant entered the Regular Air Force. On 8 Dec 64, according to the AF Form 7, Airman Military Record, he departed for Newfoundland. On 3 Jun 66, he was relieved from active duty, honorably discharged and transferred to the Air Force Reserve. He was credited with 3 years, 4 months and 9 days of active service including 1 year, 5 months and 25 days of foreign-service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends disapproval for award of the Air Force Overseas Ribbon-Long Tour. He did not complete a long tour on or after 1 Sep 80 as he separated from active duty in 1971, rendering him ineligible for award of the Air Force Overseas Ribbon-Long Tour. Furthermore, the applicant was not serving on active duty as of 6 Jan 86, rendering him ineligible for retroactive award of the Air Force Overseas Ribbon-Long Tour. DPSID also recommends disapproval for award of the Air Force Longevity Service Award. He served on active duty for 3 years, 4 months and 9 days; therefore, rendering him ineligible as his total active duty service time does not meet the criteria for award of the Air Force Longevity Service Award. To grant relief would be contrary to the criteria established by DoDM 1348.33, Secretary of the Air Force, Chief of Staff, and/or the War Department. The Air Force Overseas Ribbon was authorized by Chief of Staff, United States Air Force, on 12 October 1980. The ribbon was authorized to be awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 Sep 80. Only individuals serving on active duty as of 6 Jan 86 are eligible to have the Air Force Overseas Ribbon applied retroactively for completion of an overseas tour. The Air Force Longevity Service Award was authorized by the Secretary of the Air Force on 25 Nov 47 and is awarded to all service members of the United States Air Force who complete four years of honorable active or reserve military service. Subsequent periods of military service shall be denoted by an Oak Leaf Cluster worn on the service ribbon. The complete AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 13 Mar 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. FINDINGS AND CONCLUSIONS OF THE BOARD: After careful consideration of applicant’s request and the available evidence of record, we find the application untimely. Applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. Applicant has not shown a plausible reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice which require resolution on the merits. Thus, we cannot conclude it would be in the interest of justice to excuse the applicant’s failure to file in a timely manner. THE BOARD DETERMINES THAT: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness.
