RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-05011 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He receive service credit for all Temporary Duty (TDY) tours in Southeast Asia (SEA) and be awarded all unit awards and citations. APPLICANT CONTENDS THAT: All SEA tours with the 354th Tactical Fighter Wing was never included on his DD Form 214, causing many unpleasant situations. The applicant’s complete submission, with attachment, is at Exhibit A. STATEMENT OF FACTS: On 31 Jan 72, the applicant initially entered the Regular Air Force. On 1 Apr 77, the applicant was released from active duty and transferred to the Air Force Reserve. He was credited with 5 years, 2 months, and 1 day of active service, including 1 year and 9 months of foreign service. DPSID will administratively correct the applicant's record to reflect entitlement to the following awards and/or decorations: Presidential Unit Citation (PUC) Air Force Outstanding Unit Award (AFOUA) Vietnam Service Medal with two Bronze Service Stars (VSM w/2BSS) Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) AIR FORCE EVALUATION: AFPC/DPAPP recommends denial of the applicant’s request for service credit in Vietnam. DPAPP notes a review of his Master Personnel Records (MPR) and documentation submitted failed to provide any documents that substantiate foreign service time in Vietnam. The complete DPAPP evaluation is at Exhibit C. AFPC/DPSID indicates no action is required. DPSID has administratively corrected the applicant’s record to reflect award of the PUC; the AFOUA; the VSM w/2BSS; and the RVNGC w/P. Additionally, DPSID notes that according to the applicant's Airman Performance Reports (APR)(AF Form 909) he was assigned to the 345th Munitions Maintenance Squadron, Myrtle Beach Air Force Base, South Carolina, between 31 Jan 72 and 1 Apr 77, with duty at Korat Royal Thai Air Force Base, Thailand, between 31 Jan 72 and 18 Dec 74. The 345th Munitions Maintenance Squadron received award of the PUC for the inclusive period from 10 Oct 72 to 30 Apr 73; the AFOUA for the inclusive period from 1 Mar 71 to 31 May 72. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 26 May 15 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice in regard to his request for Vietnam service credit. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the DPAPP and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. 4. Notwithstanding the above, sufficient relevant evidence has been presented to demonstrate the existence of an injustice warranting corrective action. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the applicant is the victim of an error or injustice. In this respect, we note the evidence of record substantiates the applicant had tours of duty at Korat Royal Thai Air Force Base, Thailand, between 31 Jan 72 and 18 Dec 74 and therefore is entitled to the Vietnam Service Medal with two Bronze Service Stars (VSM w/2BSS) and the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P). Therefore, we conclude the applicant had “boots on the ground in Thailand.” Accordingly, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he had boots on the ground in Thailand within the time period of 31 Jan 72 and 18 Dec 74.
