RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-05028 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The four year active duty service commitment he incurred upon the approval of his 2014 Post-9/11 GI Bill transfer of educational benefits (TEB) be waived. APPLICANT CONTENDS THAT: He initially requested to transfer his Post-9/11 education benefit to his dependents on 8 Aug 11, at which time he would not have incurred any additional service commitment. There was no real guidance on how to request the transfer, service members were being given the run around, and the procedure was cumbersome. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 11 Feb 91, the applicant commenced his enlistment in the Regular Air Force. On 14 Apr 13, the applicant was released from active duty and transferred to the Retired Reserve List to await retired pay at age 60. On 5 Dec 14 the applicant was honorably discharged from the Air Force Reserve for the purpose of immediate reenlistment on 6 Dec 14 for a period of 4 years. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: ARPC/DPTT recommends denial indicating there is no evidence of an error or an injustice. The applicant did not request the transfer of the Post-9/11 benefit until 18 Nov 14. Based on the signed Statement of Understanding (SOU), he was aware of the four year service commitment and reenlisted in order to obtain the four year retainability necessary for the approval of the educational benefit transfer. The Defense Manpower Data Center (DMDC) transfer website shows the applicant’s only request for transfer of his education occurred on 18 Nov 14. The Department of Defense Instruction (DoDI) 1341.13, Post 9/11 GI Bill, states that on or after 1 Aug 13 all service members must, at the time of request, agree to serve four additional years of qualifying military service. In addition, ARPC has been available to answer questions on Post-9/11 GI Bill transfer since its inception in Aug 09 and has provided guidance to Air Force service members through the Air Force Personnel Services (AFPC) MyPers website. Furthermore, information has been available on the Air Force (AF) Portal and the Department of Veterans (DVA) website. A complete copy of the ARPC/DPTT evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 7 Jul 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. ? THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
