Meritorious Service Medal (MSM) (Administratively resolved). 2. Air Force Good Conduct Medal with five Bronze Oak Leaf Clusters (AFGCM w/5BOLC) (Administratively resolved). 3. Korean Service Medal (KSM). 4. Korean Defense Service Medal (KDSM) (Administratively resolved). 5. Air Force Overseas Ribbon-Long Tour (AFOR-LT). 6. Republic of Korea Presidential Unit Citation (ROKPUC) 7. United Nations Service Medal (UNSM). Additionally, his DD Form 214, Certificate of Release or Discharge from Active Duty, for the period of service 8 Jul 63 to 31 Jul 83, be corrected to reflect his foreign service for the Republic of Korea (Administratively resolved). APPLICANT CONTENDS THAT: He spent a full year at Osan Air Base, Republic of Korea from 11 Jan 80 to 9 Jan 81. This time is not reflected on his DD Form 214 as well as medals and or ribbons are not listed that he is eligible for. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 8 Jul 63. On 31 Jul 83, the applicant was discharged with an honorable characterization of service and was credited with 20 years and 23 days of active service. The Korean Service Medal is awarded to personnel who were assigned or attached to combat or service units designated by the Commander, Far East Air Forces, in general orders for service within the Korean Theater or adjacent areas between 27 Jun 50 and 27 Jul 54. The term “Korean Theater” as used in this instruction includes the areas that encompass North and South Korea, Korean waters, the air over North and South Korea, and the air over Korean waters. Personnel also are considered having participated in an engagement if they were members of a designated combat or service unit in the Korean Theater; a combat or service unit, other than one within the Korean Theater, which was designated by the Commander, Far East Air Force, as having directly supported the military operations in the Korean Theater; or a designated headquarters of the Far East Air Forces that exerted a distinct and contributory effort to the military operations in the Korean Theater. The personnel must have performed the prescribed service while they were on permanent assignment, on temporary duty with a designated unit or headquarters for thirty consecutive days or sixty nonconsecutive days, or in actual combat against the enemy, as reflected by an awarded combat decoration or furnished a certificate by a division, comparable, or higher unit commander, a ship, comparable, or higher unit commander, or an Air Force group, comparable, or higher unit commander stating that they actually participated in combat. The Air Force Overseas Ribbon was authorized by the Chief of Staff, United States Air Force, on 12 Oct 80. The ribbon was authorized to be awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 Sep 80. Only individuals serving on active duty as of 6 Jan 86 are eligible to have the Air Force Overseas Ribbon applied retroactively for completion of an overseas tour. The Republic of Korea Presidential Unit Citation was presented to units of the United Nations Command for service in Korea under the same conditions as would be required for the award of the Presidential Unit Citation of the United States between 27 Jun 50 and 27 Jul 53. The United Nations Service Medal was established by United Nations General Assembly Resolution 483(V), on 12 Dec 50. Presidential acceptance for the United States Armed Forces was announced by the Department of Defense on 27 Nov 51. It is awarded to members of the Armed Forces of the United States who participated in the action in Korea between 27 Jun 50 and 27 Jul 54, and who are also eligible for the Korean Service Medal. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice, with respect to the applicant’ requests for the KSM, AFOR-LT, ROKPUC, and UNSM. The applicant was assigned to the 5010th Transportation Squadron, APO Seattle 98737, which is Alaska, between 20 Jan 66 and 19 Jan 68; however, the applicant was not on active duty as of 6 Jan 86, rendering him ineligible to have the Air Force Overseas Ribbon- Long Tour applied retroactively. The applicant's dates of service are past the award inclusive period for award of the Korean Service Medal, Republic of Korea Presidential Unit Citation, and the United Nations Service Medal. The Meritorious Service Medal and the Air Force Good Conduct Medal with five Bronze Oak Leaf Clusters are annotated on the applicant's DD Form 214; therefore, no action is required. Based on their review of the applicant's official military personnel record, they were able to determine that the below Air Force Medals and/or Ribbons should have been awarded during the applicant's service from 8 Jul 63 to 31 Jul 83 and were not reflected in his records. Upon final board decision, administrative correction of the applicant's official military personnel record will be completed by AFPC/DPSOR: • Air Force Outstanding Unit Award with Valor and three Bronze Oak Leaf Cluster (AFOUA w/3BOLC) • • Korean Defense Service Medal (KDSM) • • Vietnam Campaign Medal (VCM) A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 11 Jun 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to the applicant’s requests for the Korean Service Medal (KSM), Air Force Overseas Ribbon-Long Tour (AFOR-LT), Republic of Korea Presidential Unit Citation (ROKPUC), and United Nations Service Medal (UNSM). We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
