RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-05043 COUNSEL: NONE HEARING DESIRED: NOT INDICATED APPLICANT REQUESTS THAT: His Date of Separation (DOS) on his DD Form 214, Certificate of Release or Discharge from Active Duty, should reflect 26 Aug 91 rather than 10 Feb 88. APPLICANT CONTENDS THAT: He joined the military with a six-year commitment after completing the college Air Force Reserve Officer Training Corps (AFROTC) program and being commissioned as an officer. He was on Reserve status until his discharge, in 1991, not 1988 as his DD Form 214 shows. He needs his record to reflect his commitment from 11 Feb 84 to 26 Aug 91. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 11 Feb 84, the applicant was placed on Extended Active Duty (EAD) to complete Under-Graduate Pilot Training (UPT). On 4 May 84, the applicant was released from EAD, with a reason for separation “involuntary Release: Failure to Complete Flying or Technical Training.” He was credited with 2 months and 24 days of active duty service. On 26 Aug 91, the applicant was honorably discharged from all appointments in the United States Air Force. AIR FORCE EVALUATION: AFPC/DPTS recommends denial indicating there is no evidence of an error or an injustice. DPTS notes the DD Form 214 certifies the military member's Release or Discharge from Active Duty and captures item by item, by authority, the military member's pertinent data and military service data. The DD Form 214 is prepared In Accordance With (IAW) DODI 1336.01, Certificate of Release or Discharge from Active Duty (DD Form 214/5 Series) and AFI 36-3202, Separation Documents. Therefore, we recommend for the Board to deny of the applicant's request. To approve the request would be contrary to the Department of Defense and Air Force Instruction. DPTS conducted a review of the applicant's records and provided documents. The DD Form 214 in the applicant's record was a release from active duty from 11 Feb 84 to 4 May 84. Per AFI 36- 3202, Table 2, Rule 3, a member must complete 90 continuous calendar days or more of active duty. On 5 May 84, the applicant was transferred to the Individual Ready Reserve status until he was discharged from the Air Force Reserve on 26 Aug 91. The complete DPTS evaluation, with attachments, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 6 Mar 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force Reserve office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Though we appreciate the applicant’s perspective concerning his documented service time, we find no evidence of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. 4. The applicant’s case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
