RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-05242 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her 31 Oct 14 reenlistment be corrected to include a reenlistment bonus from the Fiscal Year 2014, Air Force Reserve Command, Critical Skills AFSC Listing. APPLICANT CONTENDS THAT: As an Air Force Security Forces (3P0x1) Reservist, she was not given the opportunity to receive a reenlistment bonus when she reenlisted on 31 Oct 14. While she was eligible to reenlist in Aug 14; it took two months to prepare the documents; meanwhile it was only after she reenlisted was she informed that her AFSC was removed from the FY15 Critical Skills Listing (CSL). The memorandum to remove Security Forces from the FY15 CSL was sent by AFRC/A1 and received by her wing on 30 Oct 14; 30 days after the implementation/effective date. Her Career Advisor did not receive the information until 31 Oct 14. She argues that had the CSL been made public prior to the implementation date, she could have expedited her reenlistment so that she would have been eligible for the bonus. She also notes that the FY14 CSL list was approved on 14 May 14 and was retroactive to 1 Oct 13. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Air Force Reserves in the grade of Staff Sergeant. Between 1 Oct 13 to 30 Sep 14, the 3P0 AFSC was listed on the FY14 Air Force Reserve Command, Critical Skills AFSC Listing. On 26 Jul 14, the applicant was eligible to reenlist based on her original Expiration Term of Service of 26 Jan 15. Between 1 Oct 14 to 30 Sep 14, the 3P0 AFSC was not listed on the FY15 Air Force Reserve Command, Critical Skills AFSC Listing. On 31 Oct 14, the applicant reenlisted for six years in the grade of E-4. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFRC/A1K recommends denial indicating there is no evidence of an error or an injustice. In order to take advantage of the FY14 bonus program which contained her AFSC 3P051, the applicant needed to have reenlisted before 1 Oct 2014. Due to the DD Form 4 not being completed and signed until 31 Oct 14, she was subsequently ineligible for a bonus. After a careful review of the documentation provided by the applicant, source documents, products obtained from the Personnel Data System, and AFI 36-2612, United States Air Force Reserve (USAFR) Reenlistment and Retention Program; AFRC/A1K recommends disapproval as she was present for Unit Training Assemblies in August and September and had the ability to reenlist from 26 Jul 2014 through 30 Sept 2014, but failed to do so. A complete copy of the AFPC/A1K evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 28 Oct 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
