RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00023 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect the following: 1. Award of the Afghanistan Campaign Medal (AfgCM) (Administratively Resolved). 2. Award of the North Atlantic Treaty Organization Non-Article 5 Medal (NATO Medal). 3. Service in Afghanistan (Administratively Resolved). APPLICANT CONTENDS THAT: He served in Afghanistan from May 2010 to November 2010. While there he earned the NATO Medal and the Afghanistan Medal. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 13 Jul 04. On 23 Jan 11, the applicant was furnished an honorable discharge, and was credited with 6 years, 6 months, and 11 days of active service. On 26 Jan 15, AFPC/DPAPP notified the applicant of their determination that he had "boots on ground" foreign service time in Afghanistan, from 9 May 10 to 29 Sep 10. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial of the NATO Medal, indicating there is no evidence of an error or an injustice. To be eligible for award of the NATO Medal International Security Assistance Force Operation-Afghanistan members must have participated in the Joint Operations Area, which is the political boundaries and airspace of Afghanistan, for 30 continuous or 30 accumulated days during the award inclusive period from 1 Jun 03 to a date to be determined, and serving under NATO command or control while in the Joint Operations Area and those deployed to the Joint Operations Area under national command in support of the NATO operation. After a thorough review of the applicant’s record, it could not be determined that he was assigned under NATO command or under national command in support of the NATO operation. There was no certificate, decoration, or yearly performance report stating that the applicant served in support of the International Security Assistance Force in Afghanistan. Based on a review of the record, the OPR was able to determine the applicant’s entitlement to the Afghanistan Campaign Medal with one Bronze Service Star (AfgCM w/1BSS) and the Air Force Expeditionary Service Ribbon with Gold Border (AFESR w/GB). Upon final board decision the record will be administratively corrected. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 1 Jul 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting award of the North Atlantic Treaty Organization Non-Article 5 Medal (NATO Medal). We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. We note the Air Force OPR has determined the applicant’s eligibility for the Afghanistan Campaign Medal with one Bronze Service Star (AfgCM w/1BSS) and the Air Force Expeditionary Service Ribbon with Gold Border (AFESR w/GB) and will correct his records administratively. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
