RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00115 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: A new DD Form 214, Certificate of Release or Discharge from Active Duty, be issued to list all Air Force Medals and/or Ribbons. APPLICANT CONTENDS THAT: All his Air Force Medals and/or Ribbons should be listed on one document. The applicant’s complete submission is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 6 Jan 87. On 4 Feb 91, the applicant was furnished an Honorable discharge, and was credited with 4 years and 29 days of active service. The applicant’s DD Form 214 reflects the following Air Force Medals and/or Ribbons: - Air Force Achievement Medal - Air Force Overseas Ribbon-Long Tour - Air Force Training Ribbon On 15 Jul 14, the applicant was issued a DD Form 215, Correction to DD Form 214, Certificate of Release or Discharge from Active Duty. It added the following Air Force Medals and/or Ribbons: - Air Force Good Conduct Medal - Air Force Longevity Service Award The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSOR recommends denial indicating there is no evidence of an error or an injustice. DoD Instruction 1336.01, Certificate of Release or Discharge from Active Duty (DD Form 214/5 series), states “The DD Form 215 will be used to correct errors in the DD Form 214.” AFI 36- 3202, Separation Documents, states “Once a DD Form 214 has been issued, do not reissue it unless … the following applies”: Directed by an appellate authority, by Executive Order, or by the Office of the Secretary of the Air Force; Character of service, Separation Authority, Separation Code, Narrative Reason for Separation or Dates of Time Lost During This Period require correction; to correct a DD Form 214 would lead to more than two DD Form 215s, or a subsequent DD Form 215 corrects the same item as previously corrected using a DD Form 215. The applicant was discharged on 4 Feb 91 and on 15 Jul 14, the applicant’s DD Form 214 was amended in a manner as directed by governing directives to add awards/medals. The use of the DD Form 215 for such a correction is accurate and equitably used by all branches of the service in the same manner. To approve the applicant’s request would be counter to DoD direction. A complete copy of the AFPC/DPSOR evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 26 Aug 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
