RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00178 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His official military personnel records be corrected to reflect he held the grade of Chief Master Sergeant (E-9) when discharged. APPLICANT CONTENDS THAT: He held the grade of Master Sergeant (E-7) for one year as required. The applicant’s complete submission is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 22 Oct 82. On 23 Apr 80, the applicant was awarded a 5-skill level in his primary Air Force Specialty Code (AFSC). On 1 Aug 85, the applicant was promoted to the permanent grade of Staff Sergeant (E-5). On 24 Feb 87, the applicant was awarded a 7-skill level in his primary AFSC. On 5 Feb 88, the applicant’s commander non-selected him for reenlistment based on numerous documented instances of improprieties. On 11 Feb 88, the applicant acknowledged receipt of his non- selection for reenlistment and initialed his intent to not appeal his commander’s decision. On 16 Mar 88, the applicant was furnished an Honorable discharge, and was credited with 9 years, 1 month, and 12 days of active service. The applicant’s DD Form 214, Certificate of Release or Discharge from Active Duty, Block 4a, Grade Rate or Rank, reflects SSgt (E-5). The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSOE recommends denial indicating there is no evidence of an error or an injustice. They also note that the application is not timely. A review of the applicant’ Weighted Airman Promotion System (WAPS) file reflects he was never promoted beyond the rank of SSgt. In order to be eligible for promotion to CMSgt (E-9), an individual would need to have had 17 months time-in-grade (TIG) as a SMSgt (E-8) and 14 years time-in-service (TIS). The applicant did not meet these requirements as he was never selected for promotion to TSgt, MSgt, or SMSgt and separated from active duty after serving approximately nine years on active duty. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: In response to the Air Force Advisory, the applicant provided a letter describing when he earned his 3-skill level in 1979, followed by his 5-skill level in 1982. He contends to have graduated from a Health Care Sciences school in 1985 which awarded him a 9-skill level. FINDINGS AND CONCLUSIONS OF THE BOARD: After careful consideration of applicant’s request and the available evidence of record, we find the application untimely. Applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. Applicant has not shown a plausible reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice which require resolution on the merits. Thus, we cannot conclude it would be in the interest of justice to excuse the applicant’s failure to file in a timely manner. THE BOARD DETERMINES THAT: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.
