RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00285 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect: 1.  His Southeast Asia (SEA) tour of duty. 2.  All awards he earned during that tour of duty. (Administratively resolved) APPLICANT CONTENDS THAT: He served a one-year tour of duty at Ubon Republic of Thailand Air Force Base (RTAFB) in direct support of aircraft flying to Viet Nam 1972 to 1973. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 14 Mar 69. On 19 Nov 77, the applicant was furnished an honorable discharge, and was credited with 11 years, 8 months, and 11 days of active service, including 1 year, 10 months, and 25 days of foreign service. The remaining relevant facts pertaining to this application are contained in the memoranda prepared by the Air Force offices of primary responsibility (OPR), which are attached at Exhibits C and D. AIR FORCE EVALUATION: AFPC/DPAPP recommends denial indicating there is no evidence of an error or an injustice. The information provided and master personnel records did not contain documentation reflecting that the applicant served in Vietnam, but they were able to verify and confirm foreign service boots on ground at Ubon Airfield, Thailand, from 27 Nov 72 to 25 Nov 73. A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. AFPC/DPSID recommends no action be taken by the Board. They reviewed the applicant’s official military personnel record, and determined that the Vietnam Service Medal with one Bronze Service Star (VSM w/1BSS), and the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P), should have been awarded during the applicant’s service from 9 Mar 66 to 19 Nov 77; were not reflected in his records. On 18 Apr 15, AFPC/DPSID directed AFPC/DPSOR to administratively correct the applicant’s record and send him a corrected DD Form 215 reflecting said changes. A complete copy of the AFPC/DPSID evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS: The applicant refuted that he was asking for his DD Form 214 to reflect he had duty in Vietnam. He stated that he wants his record to reflect a Southeast Asia tour as a result of his tour of duty at Ubon RTAFB from Nov 72 to Nov 73, and that he be awarded the Republic of Vietnam Campaign Medal, as did other airmen he knows that served in Thailand but not Vietnam. A complete copy of the applicant’s rebuttal is at Exhibit F. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely, however, it is in the interest of justice to excuse the failure to timely file. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After a thorough review of the evidence of record and the applicant’s complete submission, to include his rebuttal, we are not convinced that relief is warranted. We note the comments of AFPC/DPAA indicating they were able to verify and confirm foreign service boots on ground at Ubon Airfield, Thailand, from 27 Nov 72 to 25 Nov 73, but found no documentation reflecting the applicant served in Vietnam. Additionally, research revealed his DD Form 214 issued 19 Nov 73, reflects one year, ten months, and seventeen days of foreign service, with block 19 showing 358 days of Indochina (the peninsula of southeast Asia comprising Vietnam, Laos, Cambodia, Thailand, Burma, and the mainland territory of Malaysia) or Korea Service. His DD Form 214 issued 19 Nov 77 reflects eight days of foreign service, with block 19 showing eight days of Indochina or Korea service. Both DD Forms 214 mentioned above reflect Ubon Airfield, Thailand as the duty station at which he either entered into or separated from the duty reflected on the respective DD Form 214. We note that AFPC/DPSID’s research revealed the Vietnam Service Medal with one Bronze Service Star (VSM w/1BSS), and the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P), should have been awarded during the applicant’s service from 9 Mar 66 to 19 Nov 77; but, were not reflected in his records. We further note that AFPC/DPSOR will administratively correct the applicant’s record and send him a corrected DD Form 215 reflecting said changes. Regarding the applicant’s request for the Vietnam Campaign Medal (VCM); we note the VCM is awarded to members of the United States Armed Forces who, between 1 Mar 61 and 28 Mar 73 served for 6 months in South Vietnam, or, served outside the geographical limits of South Vietnam and contributed direct combat support to the Republic of Vietnam Armed Forces for an aggregate of 6 months. The applicant’s records revealed he served at Ubon Airfield Thailand from 27 Nov 72 to 25 Nov 73. As the qualifying time for award of the VCM is between 1 Mar 61 and 28 Mar 73, he is two months short of the six-month requirement inside the award inclusive dates to be awarded the VCM. Therefore, in view of the above and in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
