RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00346 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His uncharacterized service be changed to honorable. APPLICANT CONTENDS THAT: He is in the process of becoming a police officer and his uncharacterized service is hindering employment opportunities. He should be able to pursue a career without having his service hinder him. He was never in trouble or received any disciplinary actions. He is a volunteer firefighter and active in the community. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 3 November 2009, the applicant entered the Regular Air Force and was discharged on 4 March 2010 with uncharacterized service and a narrative reason for separation of “Entry level performance and conduct.” He served 4 months and 2 days on active duty. AIR FORCE EVALUATION: AFPC/DPSOR recommends denial. Based on the documentation on file in the master personnel records, the discharge to include the Separation Program Designator (SPD) code, narrative reason for separation and character of service was appropriately administered and within the discretion of the discharge authority. DPSOR found no evidence of an error or injustice relating to the discharge processing. On 22 February 2010, the applicant’s commander notified him that he was recommending he be discharged for entry level performance or conduct – failure to make satisfactory progress in a required training program. The applicant failed Block 1, Unit 6, Tests 1A, 1B and 1C and was eliminated from the Security Forces Journeyman course. The applicant acknowledged receipt of the notification and was afforded the opportunity to consult with legal counsel and submit statements in his own behalf. The base legal office reviewed the package and found it legally sufficient to support the separation. Since he was on active duty for only 112 days when the discharge action was initiated, he must be separated with an Entry Level Separation (ELS). Airmen are given ELS/uncharacterized service characterization when separation is initiated in the first 180 days of continuous active service. The DOD determined if a member served less than 180 days continuous active service, it would be unfair to the member and the service to characterize their limited service. Therefore, the uncharacterized service on his DD Form 214, Certificate of Release or Discharge from Active Duty, is correct and IAW DOD and Air Force instructions. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 July 2015 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
