RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00366 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be awarded the Nuclear Deterrence Operations Service Medal (NDOSM). APPLICANT CONTENDS THAT: He met the eligibility criteria for award of the NDOSM. The Air Force approved the award for Airmen who were stationed at nuclear bases from 27 Dec 91 through the present. He was stationed at Minot AFB, ND, serving as member of the Security Forces, and believes he should receive the decoration. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 25 Sep 01. On 26 Dec 02, the applicant’s commander notified him he was recommending him for discharge from the Air Force for a pattern of misconduct which was prejudicial to good order and discipline. The reasons for taking this action were: a.  On or about 13 Nov 02, the applicant failed to go at the time prescribed to his place of duty; and on or about 2 Dec 02, without authority, went absent from the unit at which he was required to be, and remained absent until 1830. For this, his suspended non-judicial punishment, dated 24 Jul 02, was vacated. b.  On or about 9 Dec 02, the applicant was stopped by base safety for not wearing a seatbelt while operating a motor vehicle on the installation. For this he received a Letter of Counseling (LOC). c.  On or about 7 Nov 02, the applicant was given a direct order to take at least one pre-CDC test per day over the four day holiday weekend of 8 Nov 02 through 11 Nov 02, and failed to obey the order. For this he was given a Letter of Reprimand (LOR). d.  On or about 1 Aug 02, the applicant failed to report back to duty at the prescribed time after a 15 minute break. For this he was given a LOR. e.  Between on or about 31 May 02 and 4 Jun 02, the applicant unlawfully struck his wife on the face, chest, arm and leg with his hand, and on or about 4 Jun 02, without proper authority, willfully damaged a door in base housing by kicking it. For this he was punished under Article 15 of the Uniform Code of Military Justice (UCJM), and an Unfavorable Information File (UIF) was established on him. On 27 Dec 02, the applicant’s commander recommended him for involuntary separation. The applicant acknowledged receipt, contacted legal counsel, and chose not to submit a written statement on his own behalf. The case was reviewed and determined to be legally sufficient. On 7 Jan 03, the discharge authority directed the applicant be involuntarily discharged with a General (Under Honorable Conditions) discharge, without offering probation or rehabilitation. On 10 Jan 03, the applicant was furnished a General (Under Honorable Conditions) discharge, with a Narrative Reason for Separation of “Misconduct,” and was credited with 1 year, 03 months, and 15 days of total active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The NDOSM was authorized on 27 May 14 to recognize direct support to nuclear deterrence operations. It may be awarded retroactively to 27 Dec 91 to Airman who, while assigned, attached, deployed or mobilized, provided support to the Nuclear Enterprise for 120 consecutive or 179 nonconsecutive days and were subject to a Nuclear Inspection or performed duties in nuclear operations; nuclear weapons storage facilities; nuclear command, control, and communications (C3); cyber surety; security, safety, transportation, maintenance, facility management and maintenance; explosive ordnance disposal; aircrew certified for support to nuclear operation; weapons loaders; warning and attack assessment; personnel reliability program (PRP) management; or, research, development and acquisition of nuclear weapons. The NDOSM is not to be awarded if the Airman’s service has not been honorable. A thorough review of the applicant’s official military personnel failed to verify that he qualified for award of the NDOSM. While the applicant was assigned to a unit that supported the Nuclear Enterprise, and may have performed duties as a security forces apprentice, he was involuntarily discharged for misconduct. His service was not entirely honorable, rendering him ineligible. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 Jul 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of AFPC/DPSID and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
