RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00375 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her records be corrected to reflect that she has 10 years of active commissioned service. APPLICANT CONTENDS THAT: Prior to her retirement, she was never informed that she was required to complete 10 years of active commissioned service in order to retire as an officer. Over two months after her retirement, the Defense Finance and Accounting Service informed her that she did not have sufficient commissioned time to qualify for retirement in the grade of major and would be paid as a master sergeant (E-7). The Air Reserve Personnel Center (ARPC) advised her that the technician who originally processed her retirement application “dropped the ball.” The error was out of her control. Had she been made aware of the 10-year requirement, she could have requested a waiver. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to data extracted from the Military Personnel Data System, the applicant served 9 years, 10 months and 7 days of Total Active Federal Commissioned Service. The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force Office of Primary Responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: ARPC/DPTT recommends approval. The applicant was misinformed that she was eligible for retirement effective 1 November 2014, in the grade of major. On 31 January 2014, the applicant applied for an active duty retirement under the provisions of Title 10, United States Code (USC), § 891l, Twenty years or more: regular or reserve commissioned officers. The application was approved and Special Order AA-1022 was issued on 24 July 2014, establishing her retirement in the grade of major effective l November 2014. In January 2015, it was discovered the applicant did not have the required commissioned service to retire in an officer grade. Title l0, USC, § 891l requires 10 years of active commissioned service; however, the applicant only completed 9 years, 10 months and 7 days of active commissioned service. Reserve Order AA- 0258 dated 27 January 2015, was subsequently issued to rescind the applicant's 1 November 2014 retirement. Immediately following her retirement effective date, the applicant relocated and moved her family to another state. It is no longer feasible for the applicant to complete additional active service with her former unit. In addition, she has suffered financial hardship due to non-receipt of expected active duty retired pay. If the Board agrees, the records should be corrected to show the applicant was awarded 53 non-paid active duty days in Retention/Retirement Year ending 8 July 2005. This would give the applicant 10 years of active commissioned service and allow her to retire effective 1 November 2014 in the grade of major. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 3 June 2015, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office Exhibit C). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting relief. Having carefully reviewed this application, we agree with the recommendation of the Air Force OPR and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, we recommend the applicant's records be corrected as set forth below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that she was credited with an additional 53 non-paid active duty days for retention/retirement year ending 8 July 2005, resulting in 10 years of active commissioned service.
