RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00416 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect the Air Force Overseas Ribbon-Long (AFOR-L) tour. APPLICANT CONTENDS THAT: He spent 15 years, 7 months and 11 days overseas. He only recently found out the award existed. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 18 Mar 58. On 30 Sep 80, the applicant retired and was credited with 22 years, 6 months, and 13 days of active service. The applicant’s DD Form 214 reflects 15 years, 7 months and 11 days of Foreign Service and the award of the following Air Force Medals and/or Ribbons: - Distinguished Flying Cross - Air Medal with three Oak Leaf Clusters - Air Force Commendation Medal - Small Arms Expert Marksmanship Ribbon - Army Good Conduct Medal - Air Force Longevity Service Award with four Oak Leaf Clusters - National Defense Service Medal - Vietnam Service Medal with two Bronze Service Stars - Republic of Vietnam Campaign Medal - Republic of Vietnam Gallantry Cross with Palm - Air Force Outstanding Unit Award with one Oak Leaf Cluster - Air Force Good Conduct Medal with four Oak Leaf Clusters The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The AFOR-L was authorized by the Chief of Staff, United States Air Force, on 12 Oct 80. The ribbon was authorized to be awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 Sep 80. Only individuals serving on active duty as of 6 Jan 86 are eligible to have the Air Force Overseas Ribbon applied retroactively for completion of an overseas tour. After a thorough review of the applicant’s official military personnel record, they were unable to verify award of the AFOR- L. His dates of service were from 18 Mar 58 through 30 Sep 80 and are prior to the authorization date for the award of the AFOR-L. He was not on active duty as of 6 Jan 86 to be eligible for the award retroactively; therefore, he is ineligible for the award. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 27 Aug 15, the applicant provided dates of all overseas tours in support of his response. In addition and separate from the original request, he provided a copy of an approved Meritorious Service Medal, Special Order GA-286, dated 2 Oct 80, in which he claims was missing from his DD Form 214. AIR FORCE EVALUATION: AFPC/DPSID reviewed the MSM data provided and directed AFPC/DPSOR to issue the applicant a DD Form 215, Correction to DD Form 214, Certificate of Release or Discharge from Active Duty, adding the MSM to his list of authorized decorations. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
