RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-00420 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His application for Post-9/11 GI Bill transfer of eligibility (TEB) benefits submitted on 11 Mar 12 be approved. APPLICANT CONTENDS THAT: He extended his enlistment in order to qualify for TEB, but found out later his request was not approved. During the application process, he mistakenly did not push a button acknowledging completion of the request. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 15 Jun 94. On 30 Mar 12, the applicant signed an AF From 1411, Extension or Cancellation of Extensions of Enlistment in the Regular Air Force (REGAF)/Air Force Reserve (AF Reserve)/Air National Guard (ANG), extending his enlistment for four years for the purpose of “obtaining retainability for transfer of educational benefits.” The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIT recommends denial indicating there is no evidence of an error or an injustice. On 11 Mar 12, the applicant applied for TEB. The member was presented with a message on the MilConnect website which read: “YOUR TRANSFER IS NOT FINAL UNTIL YOU DIGITALLY SIGN AF FORM 4460 (POST 9/11 TRANSFER OF EDUCATIONAL BENEFITS STATEMENT OF UNDERSTANDING) IN VIRTUAL MPF. Within 72 duty hours, you will receive an Air Force Personnel Center (AFPC) email with “TEB INCIDENT” in the subject line, stating that your AF Form 4406 is ready for signature. If you DO NOT receive this email, call the Total Force Service Center (TFSC) at 1-800-525-0102 ASAP!” On 26 Mar 12, the applicant was sent an e-mail notification stating his application was rejected. The member did not sign the TEB Statement of Understanding (SOU) within the application period of 14 days. The applicant’s date of separation is 7 Nov 16. A complete copy of the AFPC/DPSIT evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 6 Jul 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an injustice. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the applicant is the victim of an error or injustice. While we note the comments of AFPC/DPSIT indicating relief should be denied because the applicant did not sign the TEB SOU in Mar 12, we believe a preponderance of the evidence substantiates that corrective action is warranted. In this respect, we note the applicant has provided a copy of his AF Form 411, Extension or Cancellation of Extensions of Enlistment in the Regular Air Force (REGAF)/Air Force Reserve (AF Reserve)/Air National Guard (ANG), dated 30 Mar 12, which extended his enlistment for the required period of time to qualify for TEB, and stated the purpose of the extension was to “obtain retainability for Transfer of Educational Benefits.” In view of this and noting the applicant did take affirmative action to obtain the necessary retainability to transfer his educational benefits, we find a sufficient basis to conclude that he has been the victim of an injustice. Therefore, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that on 11 March 2012 he elected to transfer his Post-9/11 G.I. Bill educational benefits..
