IN THE MATTER OF: DOCKET NUMBER: BC-2015-00803 COUNSEL: NONE HEARING DESIRED: NOT INDICATED APPLICANT REQUESTS THAT: Her records be corrected to reflect award of the Nuclear Deterrence Operations Service Medal with one Bronze Oak Leaf Cluster (NDOSM w/1 BOLC). APPLICANT CONTENDS THAT: She served during the period the medal was authorized but left active duty before it was annotated on her DD Form 214, Certificate of Release or Discharge from Active Duty. The applicant’s complete submission is at Exhibit A. STATEMENT OF FACTS: The applicant served on active duty from 2 Feb 10 to 20 Jul 14, and was credited with 4 years, 5 months and 29 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial for the NDOSM w/1 BOLC indicating there is no evidence of an error or an injustice. There was no evidence to show the applicant met the criteria for the NDSOM w/1 BOLC. However, her entitlement to the NDSOM basic was verified and will be administratively added to her records. The NDOSM was established on 27 May 14 and is retroactive to 27 Dec 91. Service members are awarded the NDOSM (basic) who, while assigned, attached, deployed, or mobilized to a unit, provided support to the Nuclear Enterprise for 120 consecutive or 179 nonconsecutive days, and the unit was subjected to a Nuclear Inspection or performed duties in nuclear operations to include nuclear weapon storage facilities, nuclear command, control, and communications (NC3), cyber surety, security, safety, transportation, maintenance, facility management and maintenance, explosive ordnance disposal, aircrew certified for support to nuclear operations, weapons loaders, warning and attack assessment, personnel reliability program (PRP) management, or research, development and acquisition of nuclear systems. Service member must have served honorably to receive the Nuclear Deterrence Operations Service Medal. An OLC will be worn to denote subsequent awards. Subsequent awards will only be authorized when a permanent change of station (PCS) to a qualifying unit has occurred. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 Jul 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. There was no evidence provided to show the applicant met the criteria for award of the Nuclear Deterrence Operations Service Medal with one Bronze Oak Leaf Cluster. We note the OPR has determined the applicant’s eligibility for the basic Nuclear Deterrence Operations Service Medal and will correct the records administratively. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting relief beyond that rendered administratively. 4. The applicant’s case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
