RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-00870 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be eligible under the 2012 Post 9/11 GI Bill Transfer of Education Benefits (TEB) criteria; 3 versus 4 year Active Duty Service Commitment (ADSC). APPLICANT CONTENDS THAT: He submitted his original request prior to the new ADSC of 4 years. After he submitted the application in March 2012, he never received any emails stating what else he needed to do. He submitted his request several more times with no success. Once he got in touch with the Air Force Personnel Center (AFPC), they were able to reset his information and he was able to sign his Statement of Understanding (SOU). At the time he signed it, the ADSC had been extended from a 3 year to a 4 year commitment. In support of his request, the applicant has provided multiple E-mails between himself and AFPC dated between 2013 and 2015. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of Master Sergeant. On 18 Mar 12, the applicant initially applied for Post 9/11 GI Bill TEB, if approved at that time he would have incurred a 4 year ADSC. On 19 Mar 12, the Total Force Service Center sent a notification E-mail instructing the applicant to sign a Statement of Understanding. On 2 Apr 12, the applicant’s application was denied because he failed to sign the TEB SOU. On 14 Nov 13, the applicant reapplied for the TEB and was approved with an ADSC date of 14 Nov 17. On 9 Dec 13, the applicant digitally signed his SOU acknowledging his approval and new ADSC date of 14 Nov 17. On 4 Apr 15, the applicant submitted paperwork to retire. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIT recommends denial indicating there is no evidence of an error or an injustice. Right Now Technology (RNT) notes show the applicant was sent an initial notification E-mail on 19 Mar 12 from the TFSC with all action required to complete his TEB application. He failed to sign and return the Statement of Understanding. The applicant was sent a second E-mail on 2 Apr 12 notifying him of the application expiration. The applicant reapplied and was approved on 14 Nov 13 with an ADSC of 13 Nov 17. It should be noted that based on the date the applicant initially applied to TEB, he would have still incurred a 4 year ADSC. A complete copy of the AFPC/DPSIT evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 Sep 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
