RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01048 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to add the Kuwait Liberation Medal- Kuwait (KLM) and the Kuwait Liberation Medal-Saudi Arabia (KLM-SA) (Administratively Corrected). By virtue of a second DD form 149, the applicant requests the Armed Forces Services Medal (AFSM) be added to his DD Form 214. APPLICANT CONTENDS THAT: He is eligible for the KLM and KLM-SA because he deployed to Saudi Arabia on 2 Aug 90 at the start of OPERATION DESERT SHIELD and served there until the end of DESERT STORM on 23 Feb 91. He is eligible for the AFSM because he deployed to Sicily in 1993 in support of NATO OPERATION PROVIDE PROMISE. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 5 Feb 75, the applicant entered the Regular Air Force. On 29 Feb 96, the applicant was furnished an honorable discharge, and was credited with 20 years, 3 months, and 26 days of active service, which includes 11 years, 7 months and 22 days was foreign service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends award of the KLM and KLM-SA indicating there is sufficient evidence of an error. Based on a review of the applicant's official military personnel record, it was determined the below Air Force Medals and/or Ribbons should have been awarded during the applicant's service from 5 Nov 75 to 29 Feb 96 and were not reflected in his records: * Air Force Outstanding Unit Award with one Silver Oak Leaf Cluster (AFOUA w/1SOLC) * Korean Defense Service Medal (KDSM) * Kuwait Liberation Medal-Saudi Arabia (KLM-SA) * Kuwait Liberation Medal-Kuwait (KLM-K) Upon final Board decision, the applicant’s official military personnel record will be administratively corrected. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. AFPC/DPSID recommends denial of the AFSM indicating there is no evidence of an error or an injustice. The AFSM is awarded for direct support of Operation PROVIDE PROMISE between 2 Jun 92 and 15 Feb 96. It is awarded only to participants deployed in support of the Former Republic of Yugoslavia in Italy, Hungary, and the waters and air space above the portion of the Adriatic Sea that lies north of the 40 degrees North Latitude. The applicant provided a travel order indicating he was to deploy to Italy on or about 8 Apr 93 in support of Operation PROVIDE PROMISE. However, without a paid Travel Voucher it is not possible to verify if the deployment was completed. The applicant's Senior Enlisted Performance Report (DD Form 911) dated from 23 May 92 to 22 May 93 indicates the applicant was deployed to Naval Air Station Sigonella, in support of Operation DENY FLIGHT. Although, Operation DENY FLIGHT is a qualifying operation for award of the AFSM, the DD Form 911 does not give specific dates of the deployment. To grant relief would be contrary to the criteria established by DoDM 1348.33, Secretary of the Air Force, Chief of Staff, and/or the War Department. A complete copy of the AFPC/DPSID evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 22 Dec 15 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error to award the AFSM. After a thorough review of the evidence of record, and the applicant’s complete submission, we believe the applicant is the victim of an error. We note AFPC/DPSID indicates award of the AFSM should be denied because the applicant’s records do not provide specific dates of deployment in support of operation DENY FLIGHT. However, the Board believes the preponderance of evidence exists to substantiate award of the AFSM. In this respect, we note the applicant’s Enlisted Performance Report, from 23 May 92 to 22 May 93, indicates he deployed in support of operation DENY FLIGHT, a qualifying operation for award of the AFSM. Given that the award’s initial inclusive period began on 2 Jun 92, and he provided travel orders in support of operation PROVIDE PROMISE, another qualifying operation for award of the AFSM, the board finds it more likely than not he provided direct support to Provide Promise during the award’s inclusive dates. Additionally, we note AFPC/DPSID is taking administrative corrective action to award the AFOUA w/1SOLC, KDSM, KLM-SA, and KLM-K. Therefore, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show he was awarded the Armed Forces Services Medal.
