RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01096 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be updated with the following: Southwest Asia Service Medal (SWASM); Administratively corrected Kuwait Liberation Medal – Kuwait (KLM-K); and Kuwait Liberation Medal – Saudi Arabia (KLM-SA). APPLICANT CONTENDS THAT: He was on Temporary Duty (TDY) for a Chairman of the Joint Chiefs of Staff (CJCS) Contingency from 14 Aug 90 to 11 Nov 90, with an amended order extending the TDY to 179 days. His deployment was during the timeframe when the medals were awarded, but they are not on his DD Form 214. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 14 Apr 83, the applicant entered the Regular Air Force. According to DD Form 215, Correction to DD Form 214, Certificate of Release or Discharge from Active Duty, dated 31 Jul 92, Block 13, Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized, reflects the SWASM; and Block 18, Remarks, reflects “Deployed to Area of Responsibility from 15 Aug 90 to 13 Mar 91 in Support of Operation DESERT SHIELD/STORM.” On 1 Aug 92, the applicant was released from active duty and transferred to the Air Force Reserve. He was credited with 9 years, 3 months, and 18 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends the board decide whether to award the KLM- K and the KLM-SA based on the documentation provided by the applicant, as they were unable to verify either award. The applicant indicates in his request that he was providing Special Order TD-169, however; he did not provide it. There was no official documentation in the applicant’s record to verify his length of foreign-service was longer than 90 days. Special Order TD-705, dated 14 Aug 90 indicates the applicant was deployed for 90 days on Special Mission Travel; however, no country is provided. Defense Finance and Accounting Service (DFAS) verified the applicant’s foreign-service from 1 Nov 90 to 31 Dec 90; however, no country code was given. The DD Form 215 states the applicant deployed to the area of responsibility from 15 Aug 90 to 13 Mar 91 in support of Operation DESERT SHIELD/STORM; however, no country is provided. Although the applicant received award of the SWASM, per DD Form 215 dated 31 Jul 92, the area of eligibility is not entirely the same for ward of the KLM-SA or KLM-K. Without knowing the location of the deployment, we are unable to verify award of the KLM-SA or KLM-K. To grant relief would be contrary to the criteria established by DoDM 1348.33, Manual of Military Decorations and Awards, the Secretary of the Air Force, the Chief of Staff, and/or the War Department. The KLM-K is awarded to members who participated in Operations DESERT SHIELD/DESERT STORM, and the Liberation of Kuwait. Military personnel must have served between 2 Aug 90 and 31 Aug 93, in one or more of the following areas: the Persian Gulf, Red Sea; Gulf of Oman; that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden, or, the total land area of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar and United Arab Emirates. The KLM-SA is awarded members who participated in Operation DESERT STORM, and the Liberation of Kuwait. Military personnel must have served between 17 Jan 91 and 28 Feb 91 in one or more of the following areas: the Persian Gulf, Red Sea; Gulf of Oman; that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden, or, the total land area of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar and United Arab Emirates. Based on review of the applicant’s official military personnel record, DPSID was able to determine that the below Air Force Medal and/or Ribbon should have been awarded during the applicant’s service form 14 Apr 83 to 1 Aug 92 and was not reflected in his records. Upon final board decision, administrative correction of the applicant’s official military personnel record will be completed by AFPC/DPSOR: *Southwest Asia Service Medal with one Bronze Service Star (SWASM w/1BSS) A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 23 Oct 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting correction of the applicant’s records to reflect his entitlement to the KLM-K and KLM-SA. While we note the Air Force OPR has verified the applicant's eligibility for the SWASM w/1BSS and will correct his records administratively, we do not find the evidence presented sufficient to conclude the applicant should have been awarded the KLM-K and KLM-SA. In this respect, we note the comments of AFPC/DPSID indicating that without knowing the country location of the deployment 15 Aug 90 to 13 Mar 91, they were unable to verify eligibility to the KLM-K and KLM-SA. In our discussion, we established that while there is ample evidence of his deployment supporting Operations DESERT SHIELD/STORM in the area of responsibility, that evidence lacks location specific details required to verify his eligibility for the KLM-K and KLM-SA. Therefore, we find no basis to recommend granting any relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
