RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-01165 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her AF Form 475, Training Report (TR), issued by the Air Force Institute of Technology (AFIT) on 22 Apr 13 for completion of WMGT 101, Introduction to the Base Civil Engineering Organization Course, be removed from her record and replaced with the corrected AF Form 475 issued by AFIT on 16 Jul 13. APPLICANT CONTENDS THAT: An incorrect academic average and final standing was included on the original AF Form 475. Upon review, AFIT issued an explanatory Memo For The Record (MFR) and revised her AF Form 475 to make it accurate, but her official record was not updated to include the corrected report. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force in the grade of second lieutenant on 28 May 12. On 22 Apr 13, the applicant was furnished an AF Form 475, Education/Training Report, covering the period 15 Jan 13 through 23 Mar 13 for the Introduction to the Base Civil Engineering Course, on which she was not identified as a Distinguished Graduate. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIDE recommends denial. The Air Force Board for Correction of Military Records (AFBCMR) is the highest level of administrative appeal within the Department of the Air Force. Under the provisions of AFI 36-2603, Air Force Board for Correction of Military Records, the AFBCMR will not consider a case until all avenues of administrative relief have been exhausted. The applicant did not apply to the Evaluation Reports Appeal Board (ERAB), thus has not exhausted all available avenues of administrative relief prior to seeking correction of their military records. In accordance with (IAW) AFI 36-2406, Officer and Enlisted Evaluation Systems, dated 3 Jan 13, if an applicant is requesting a report be reaccomplished, they must furnish a substitute report. The substitute report must be signed by the evaluator(s) who signed the original report. In addition, the applicant must include supporting memoranda from the original rating official(s) who signed the original report to justify/explain the change(s) made to the contested report. We recommend the applicant submit an AF Form 948, Application for Correction/Removal of Evaluation Reports, with all required supporting documentation, through the MPF/Evaluation Appeals found under the Most Popular Applications for consideration by the ERAB. A complete copy of the AFPC/DPSIDE evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 2 Dec 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant did not exhaust all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. While we note the comments of AFPC/DPSIDE indicating relief should be denied because the applicant did not exhaust all administrative remedies before applying to the Board, we believe a preponderance of the evidence substantiates that corrective action is warranted, and to deny the applicant’s request due to failure to exhaust administrative remedies would only unnecessarily prolong the documented injustice to the applicant and consume the time and resources of other Air Force offices, only to ultimately produce the same relief presently requested. In this respect, we note the applicant provided a copy of a signed memorandum from the Dean of The Civil Engineer School, Air Force Institute of Technology, stating the applicant’s original AF Form 475, dated 22 Apr 2013, was incorrect and providing a corrected copy for her records. Therefore, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that her AF Form 475, Education/Training Report, dated 22 April 2013, for completing course WMGT 101, Introduction to the Base Civil Engineering Organization Course, be declared void and removed from her record and replaced with the AF Form 475 for WMGT 101, dated 16 July 2013.
