RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01268 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be awarded the Air Medal. APPLICANT CONTENDS THAT: He flew 28 missions with the 4th Emergency Rescue Squadron from Apr 45 to Aug 45. He was told that after his 25th mission he would be awarded the Air Medal. The process for the award was put on hold and never completed. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Army Air Force on 11 Feb 44. On 8 Jan 46, the applicant was furnished an honorable discharge, and was credited with 1 year, 2 months, and 6 days of active service, to include 8 months and 22 days of foreign service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The Air Medal may be awarded to any person who, while serving in any capacity with the United States Armed Forces, subsequent to 8 Sep 39, distinguishes himself or herself by meritorious achievement while participating in an aerial flight. It may be awarded for combat or non­combat action in recognition of single acts of valor, heroism, or merit while participating in an aerial flight. Additionally, it may be conferred for sustained meritorious achievement (distinction) in the performance of duties involving aerial flight. In accordance with headquarters Army Air Force 14 Aug 43 memorandum to all theater commanders; the so-called “routine or score card” basis of award of the Air Medal was officially prohibited as of 14 Aug 43. It appears the applicant’s records were heavily damaged in the fire at the National Personnel Records Center in 1973. After a thorough review of his limited military personnel record, they were unable to verify award of the Air Medal. There is no official documentation, such as a recommendation or Special Order, in his records, nor did he provide any documentation to verify he was recommended for or awarded the Air Medal. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 14 Sep 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
