RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS, IN THE MATTER OF: DOCKET NUMBER: BC-2015-01303 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1. His DD Form 214, Armed Forces of the United State Report of Transfer or Discharge, issued in conjunction with his 26 Jan 71 discharge be corrected to reflect award of the Vietnam Campaign Medal (VCM). (Administratively Corrected) 2. His HQ MACV training Dir (AFIS) be added to Block 25 of his DD Form 214. APPLICANT CONTENDS THAT: His DD Form 214 does not reflect his service in Vietnam and his language school training. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 27 Jan 67, the applicant initially entered active duty in the Regular Air Force for a period of four years. On 26 Jan 71, the applicant was furnished an honorable discharge, and was credited with 4 years of active service. On 10 Aug 15, AFPC/DPSIDR directed the applicant’s record be administratively corrected to reflect the following decorations/awards: • Air Force Outstanding Unit Award with Valor and two Bronze Oak Leaf Clusters (AFOUA w/V & 2BOLC) • Vietnam Service Medal with four Bronze Service Stars (VSM w/4BSS) • Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) • Vietnam Campaign Medal (VCM). On 30 Sep 15, AFPC/DPAPP notified the applicant that his request for service credit in Vietnam had been administratively corrected and he was provided a “boots on ground” for it purposes. DPAPP also noted that specific locations are not annotated on members DD Form 214s. AIR FORCE EVALUATION: AFPC/DPSID states no action required and notes that based on a review of the applicant's official military personnel record, they were able to determine the following Air Force medals and/or ribbons should have been awarded during the applicant's service from 27 Jan 67 to 26 Jan 71; however, these were not reflected in his records. Administrative correction of the applicant's official military personnel record will be completed by AFPC/DPSOR: • AFOUA w/V & 2BOLC • VSM w/4BSS • RVNGC w/P • VCM The complete DPSID evaluation is at Exhibit C. AFPC/DP2LWD recommends denial of the applicant’s request to add his training for language school to his DD Form 214 since the documents submitted do not indicate any formal training was completed. DP2LWD notes the available records indicates the applicant was assigned to the training directorate to perform manning assistance as a security policeman. The complete DP2LWD evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 27 Jan 16 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. FINDINGS AND CONCLUSIONS OF THE BOARD: Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After a careful review of the applicant's contentions, documentation submitted in support of the request, and the available evidence of record, we are not convinced the applicant has provided sufficient evidence for us to conclude that he is the victim of an error or injustice. We also note the applicant did not file the application within three years after the alleged error or injustice was discovered, or should have been discovered, as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. Therefore, because we do not find it would be in the interest of justice to recommend granting relief, and the applicant has offered no plausible reason for the delay in filing the application, we cannot conclude it would be in the interest of justice to excuse the failure to timely file the application. Accordingly, we find the application untimely. THE BOARD DETERMINES THAT: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.
