RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01312 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Report of Separation from Active Duty, be corrected to add the following awards and ribbons: 1.  Vietnam Service Medal with four Bronze Service Stars (VSM w/4BSS). 2.  Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P). 3.  Vietnam Campaign Medal (VCM). APPLICANT CONTENDS THAT: When he applied for disability with the Department of Veterans Affairs (DVA), it was brought to his attention that his DD Form 214 was not up to date. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant’s official military personnel records obtained by the National Military Processing Center (NPRC) contain very limited information. On 30 Apr 79, according to documentation provided by the applicant, he was furnished an honorable discharge from the Regular Air Force, and was credited with 20 years and 7 months of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. After a thorough review of the applicant’s limited official military personnel record, award of the VSM w/4BSS, RVMGC w/P, and VCM, could not be verified. This advisor was unable to locate any official documentation verifying the applicant served in the area of eligibility. The VSM is awarded to all members of the United States Armed Forces who served in Vietnam or contiguous waters or airspace after 3 Jul 65, and before 28 Mar 73. In addition, personnel serving in Thailand, Laos, or Cambodia in direct support of operations in Vietnam during the same time period also were eligible for the VSM. To be eligible, a service member must be: permanently assigned, attached, or detailed for one, or more, days with an organization participating in or directly supporting ground (military) operations; permanently assigned, attached, or detailed for one, or more, days aboard a naval vessel directly supporting military operations; have actually participated as a crew member in one or more aerial flights directly supporting military operations; have served on temporary duty for 30 consecutive days or 60 non-consecutive days. Those time limitations may be waived for personnel participating in actual combat operations. The VCM is awarded to members of the United States Armed Forces who, between 1 Mar 61 and 28 Mar 73 served for six months in South Vietnam, or served outside the geographical limits of South Vietnam and contributed direct combat support to the Republic of Vietnam Armed Forces for an aggregate of six months. The RVNGC w/P was awarded by the Republic of Vietnam by certain units of the Armed Forces of the United States for valorous combat achievement during the Vietnam Conflict, inclusive from 1 Mar 61 to 28 Mar 73. There are no authorized devices. The applicant provided a Report on Personnel, dated 18 Oct 78, which reflects the applicant was awarded the VSM w/4BSS, RVNGC w/P, and the VCM. However, the applicant’s name does not appear anywhere on the document; therefore, DPSID was unable to determine if it is a reflection of the applicant’s awards, as no record of his active duty service was available. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant states he has requested his records be corrected at least three times. He is aware that all pages of the documents that he provided do not have his name on them. However, at the top of the provided pages his position control number (PCN) is annotated. In support of his response, the applicant provides a copy of a boots on ground memorandum for Vietnamese service, dated 8 Nov 66. He further provides an individual flight record, for the period Jan through Jun 1966, and a combat time sheet certifying his combat and combat support missions flown. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After a thorough review of the evidence of record and the applicant’s complete submission, to include his rebuttal response, we believe the applicant is the victim of an error. While we note the comments of AFPC/DPSID indicating that relief should be denied because the applicant’s records contain no documentation substantiating his foreign service time in Vietnam, we believe a preponderance of the evidence substantiates that corrective action is warranted. In this respect, we note the applicant’s rebuttal response contains a boots on ground letter, dated 8 Nov 66, for performing combat duties in a combat zone as an aircrew member. Additionally, the applicant provides an individual flight record and combat time sheet indicating that he participated in combat flight missions in and out of Vietnam. In view of these facts, we find sufficient evidence to conclude that more likely than not, the applicant has an aggregate of 30 consecutive days or 60 non-consecutive days in the area of responsibility and therefore meets the eligibility criteria for award of the VSM, RVNGC w/P, and the VCM for direct combat support. Therefore, we believe it appropriate to recommend the applicant’s records be corrected to the extent indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his DD Form 214, Report of Separation from Active Duty, be updated to reflect the award of the Vietnam Service Medal with four Bronze Service Stars, the Republic of Vietnam Gallantry Cross with Palm, and the Vietnam Campaign Medal.
