IN THE MATTER OF: DOCKET NUMBER: BC-2015-01384 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect the authorization to wear the Civil Engineer Occupational Badge. APPLICANT CONTENDS THAT: He transferred from the Air National Guard to the Active Duty Coast Guard and was unable to review his separation documents prior to being finalized. In support of his request the applicant provided a copies his DD Form 214, NGB Form 22, National Guard Bureau Report of Separation and Record of Service, Coast Guard Message: Results of the Uniform Board 46 Prior Service Insignia, dated 20 Feb 15 and Certificate of Training, dated 30 Oct 01. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Air National Guard 9 Jun 00. On 24 Jan 01, the applicant came on Active Duty to attend Basic Military and Technical Training. On 2 Nov 01, the applicant was furnished an Honorable discharge, and was credited with nine months and nine days of active service. His DD Form 214 reflects a Primary Specialty of 3E031; Electrical Systems Apprentice. On 18 Nov 02, the applicant separated from the Air National Guard and was credited with 2 years, 5 months and 10 days of service this period. The applicant was transferred to the Active Duty Coast Guard. The applicant’s NGB Form 2 reflects a Primary Specialty of 3E031; Electrical Systems Apprentice. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: ARPC/DPTS recommends denial indicating there is no evidence of an error or an injustice. They conducted a thorough review of the applicant’s records and confirm his DD Form 214 is correct. The applicant successfully completed Electrical Systems Apprentice Course and meets the eligibility criteria to wear the Civil Engineering Occupational Badge in accordance with Air Force Instruction 36-2903, Dress and Personal Appearance of Air Force Personnel, Chapter 10, paragraph 10.4.3. A complete copy of the ARPC/DPTS evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Sep 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
