RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-01429 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His enlistment in the Arizona Air National Guard (ANG) be as a Non-Prior Service (NPS) member. His grade be corrected to Airman First Class (A1C, E-3) with Date of Rank (DOR) and effective date of 6 June 2014 and he receive the associated back pay. APPLICANT CONTENDS THAT: On 29 May 2013, he enlisted in the Regular Air Force as an Airman Basic (AB, E-1). He completed Basic Military Training (BMT) but was discharged with an Entry Level Separation (ELS) for failure to complete technical training. He then enlisted in the ANG as a prior service AB which disqualified him from enlisting as an A1C under the FY 2014 Recruiting and Retention Initiatives program. He should have enlisted as an A1C in Air Force Specialty Code (AFSC) 2A6X2, Aerospace Ground Equipment, under the NPS Critical Skills Promotion (CSP) program due to his training interruption while on active duty. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is in the ANG serving in the grade of AB. On 17 December 2013, he entered the Regular Air Force and was discharged on 5 May 2014 with an ELS. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force Office of Primary Responsibility (OPR), which is attached at Exhibit B. AIR FORCE EVALUATION: NGB/A1PP recommends denial. The applicant enlisted into the Arizona ANG correctly as a prior service member. NGB/A1P concurs with the recommendation of NGB/A1PP. According to ANGI 36-2002, Enlistment and Reenlistment in the Air National Guard and as a Reserve of the Air Force, NPS are defined as “an applicant who has no previous military service or a former member of the Armed Forces who has 83 days or less of active duty/inactive active duty.” The applicant provides a copy of his DD Form 214, Certificate of Release or Discharge from Active Duty, which reflects he was on active duty from 17 December 2013 to 5 May 2014, a total of 140 days. Furthermore, per ANGI 36-2002, members are authorized enlistment as an A1C when enlisting into a NPS CSP program. However, because the applicant was correctly enlisted as a prior service member, he is disqualified from the FY 2014 Recruiting and Retention Initiatives NPS CSP program and his grade, DOR and effective date for pay as an AB are correct. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 September 2015 for review and comment within 30 days (Exhibit C). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force OPR and adopt the rationale expressed as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
