RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01488 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He receive credit for his support of Operation ENDURING FREEDOM/Operation IRAQI FREEDOM (OEF/OIF). APPLICANT CONTENDS THAT: While assigned to Royal Air Force (RAF) Lakenheath, United Kingdom, he was deployed to RAF Feltwell, in 2004 – 2005, in support of the Iraqi War. During his deployment to RAF Mildenhall, his radar unit provided direct support to bombers going into Iraq and other destinations. He also guarded bombers as a security forces augmentee. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 26 Mar 02, the applicant initially entered the Regular Air Force. On 25 Mar 06, the applicant was furnished an honorable discharge, and was credited with four years of active service. AIR FORCE EVALUATION: AFPC/DP2WR did not provide a recommendation. DP2WR notes a data analysis was done in the Deliberate and Crisis Action Planning and Execution Segments (DCAPES) system, the deployed system of record, and no deployments for this specified period of time were found. DP2WR attached an email from the DCAPES data analysis section, dated 13 Jan 2016, showing this finding. Also a review of the Military Personnel Data System (MILPDS), the system of record for military data, was accomplished and no deployments for this specified period of time was found. A snapshot of any recorded Temporary Duties (TDYs) the applicant accomplished was attached as well. Also attached is a Single Unit Retrieval Format (SURF) from MILPDS of the applicant's military data and it reflects no deployment history. TDYs of at least 45 days in duration will be reflected on a member's surf. Information reflected will be TDY inclusive dates and whether the TDY was CONUS or OCONUS. If applicable data were to be shown it would show in the Deployment History Data section of the MILPDS SURF. At this time DP2WR is returning this case with no action taken due to no record supporting the applicant's request being found. A complete copy of the DP2WR evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 1 Feb 2016 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. FINDINGS AND CONCLUSIONS OF THE BOARD: Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After a careful review of the applicant's contentions, documentation submitted in support of the request, and the available evidence of record, we are not convinced the applicant has provided sufficient evidence for us to conclude that he is the victim of an error or injustice. We also note the applicant did not file the application within three years after the alleged error or injustice was discovered, or should have been discovered, as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. Therefore, because we do not find it would be in the interest of justice to recommend granting relief, and the applicant has offered no plausible reason for the delay in filing the application, we cannot conclude it would be in the interest of justice to excuse the failure to timely file the application. Accordingly, we find the application untimely. THE BOARD DETERMINES THAT: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.
