RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01531 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His Vietnam service be reflected on his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge. APPLICANT CONTENDS THAT: He was in Vietnam in Aug 64, right after the Gulf of Tonkin incident. He is having problems with his Veterans claims because his Vietnam service is not listed on his DD Form 214. The applicant’s complete submission is at Exhibit A. STATEMENT OF FACTS: On 8 Jan 63, the applicant commenced his enlistment in the Regular Air Force. The applicant’s, AF Form 7, Airman Military Record, indicates under section 2, Foreign Service, the applicant was on temporary duty (TDY) in Southeast Asia (SEA) for 72 days from 15 Sep 64-25 Nov 64. Additionally, section 14, Combat, of the Form 7 reflects Vietnam 15 Sep 64-25 Nov 64. On 6 Jan 67, the applicant was furnished an honorable discharge, and was credited with 3 years, 11 months, and 29 days of active service. Department of Defense Instruction (DoDI) 1336.1, Certificate of Release or Discharge from Active Duty (DD Form 214/5 Series) dated 20 August 2009, which establishes and implements policy for the preparation and distribution of the DD Form 214, does not include a provision for update of TDY assignments/locations on the DD Form 214. AFI 36-2110, Assignments, dated 22 September 2009, paragraph 3.4.4.3, states; use a combination of the following documents to verify completed TDY assignments: travel vouchers, PCS orders, decoration citations, enlisted or officer performance reports and records review Report on Individual Personnel (RIP). AIR FORCE EVALUATION: AFPC/DPAPP recommends denial indicating there is no evidence of an error or an injustice. There was no evidence found in the applicant’s official military personnel records or the documentation provided to substantiate he served in Vietnam. A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 27 Jul 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely. However, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice with regard to the applicant’s request for Vietnam service credit. After a thorough review of the evidence of record, we believe a reasonable basis exists to conclude the applicant served in Vietnam. The applicant’s AF Form 7, Airman Military Record reflects he was on temporary duty (TDY) in the Southeast Asia for 72 days from 15 Sep 64-25 Nov 64. Additionally, section 14, of the AF Form 7 reflects Vietnam, 15 Sep 64-25 Nov 64. Based on this evidence, we believe the applicant has established with sufficient evidence that he did indeed serve in Vietnam. Therefore, in view of the above, and in recognition of his service to the Nation, we recommend the applicant’s records be corrected to the extent indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he had boots on the ground in the Republic of Vietnam from 15 September 1964 through 25 November 1964.
