RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01615 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be granted supplemental consideration by the P0414C Line of the Air Force (LAF) Major’s Board in order to include the following: a. Transition Manager Duty Title, effective 20 May 05 (Administratively corrected) b. Air Medal, Eighth Oak Leaf Cluster (AM [8OLC]). c. Air Medal, Ninth Oak Leaf Cluster (AM [9OLC]). APPLICANT CONTENDS THAT: His Air Medal (AM) (8OLC) awarded for period 14 Jun 13 to 23 Jul 14 and AM (9OLC) awarded for period 10 Sep 14 to 10 Oct 14 were delayed processing through United States Central Command Air Forces (USAFCENT) and were missing during his Major’s Board. In addition, his initial duty history as a transition manager, effective 20 May 05 was missing from his records. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force, in the grade of captain/O-3. According to information provided by the applicant, his Officer Single Unit Retrieval Format (SURF), dated 7 Apr 15, his duty title, with effective duty date of 20 May 05, is documented as Transition Manager. On 10 Dec 14, he was awarded the AM w/8OLC for inclusive period 14 Jun 13 to 23 Jul 14 and the AM w/9OLC for inclusive period 10 Sep 14 to 10 Oct 14. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSOO recommends denial indicating there is no evidence of an error or an injustice. The absence of the two AMs in his Officer Selection Record (OSR) is not an error since they were awarded after the Central Selection Board (CSB) convened. The two medals were processed within the guidelines of AFI 36-2803, The Air Force Awards and Decorations Program, paragraph 3.1. These guidelines state that decoration recommendations are entered “into official channels within 2 years and awarded within 3 years of the act, achievement, or service performed.” Furthermore, in accordance with published guidance, the decoration award authority announces its final decision once the special order number is assigned to the citation. In this case, the AM (8OLC) was awarded on 10 Dec 14 by Special Order G-03813 and the AM (9OLC) was awarded also on 10 Dec 14 by Special Order G-03814. As such, since the Air Medals were awarded after the P0414C CSB convened on 1 Dec 14, the citations cannot be filed in the officer’s OSR, nor reflected on his Officer Selection Brief (OSB) for the P0414C CSB. The applicant’s request to include a missing 20 May 05 duty title as Transition Manager in the Assignment History Section on the OSB has been administratively resolved. After a thorough review of his record, to include the updated data in the Military Personnel Data System (MilPDS), the Chief of Officer Promotions and Selective Continuation Branch approved adding the 20 May 05 duty title entry to the OSB and granted SSB consideration for the P0414C CSB with the corrected OSB. The applicant will receive notification of when his record will meet the SSB, approximately 30 days prior to date it is scheduled. A complete copy of the AFPC/DPSOO evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 14 Sep 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant supplemental consideration for the P0414C CSB with respect to including the applicant’s AM (8OLC) and AM (9OLC). We took notice of the applicant’s complete submission, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force OPR and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. The applicant contends the two AMs were delayed in processing through command channels, however; they were processed within Air Force guidelines and subsequently awarded after the CSB convened. We note AFPC/DPSOO has resolved the applicant’s request to include his missing duty title in the OSB and granted Special Selection Board consideration with the corrected OSB. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
