RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01736 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, Block 16, Days Accrued Leave Paid, be corrected to reflect “21.5” instead of “0”. APPLICANT CONTENDS THAT: He was paid for 21.5 days of leave sold upon separation. Due to his DD Form 214, Block 16, reflecting zero days of leave sold, Defense Finance and Accounting Service (DFAS) is requesting repayment. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 17 Jun 08, the applicant entered the Regular Air Force. On 27 Feb 14, the applicant was furnished an honorable discharge, with a narrative reason for separation of accept commission or warrant in another branch of service, and was credited with 5 years, 8 months, and 11 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIM recommends denial indicating there is no evidence of an error or an injustice. The applicant had a leave balance of 21.5 days of leave at the time of separation. According to the applicant’s DD Form 214, he was not paid accrual leave during his Air Force career. DPSIM reviewed the applicant’s Master Military Pay Account (MMPA) to verify the applicant’s leave balance (prior to separation). According to the MMPA, the applicant had 0 days of sold leave on his account. The applicant first addressed this problem with DFAS prior to petitioning the AFBCMR. According to DFAS, the member was never credited the 21.5 days of leave and the member’s MMPA record read “0” days because the member carried forward his leave into another branch of service. The applicant provided a memorandum that stated he did sell 21.5 days of leave upon separation. However, without documentation from DFAS, DPSIM is unable to recommend the correction of the applicant’s DD Form 214. Additionally, it is recommended the applicant contact his local finance office for assistance if he was not credited the 21.5 days of leave upon commissioning into the Navy. A complete copy of the AFPC/DPSIM evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 14 Sep 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the applicant is the victim of an error. While we note the comments of AFPC/DPSIM indicating that relief should be denied because the applicant carried forward his leave into another branch of service, we believe a preponderance of the evidence substantiates that corrective action is warranted. In this respect, we note the applicant has provided a copy of a memorandum acknowledging that he sold 21.5 days of leave upon his separation, as well as military leave and earnings statements for the period under review indicating that his leave was not carried over to the Navy. Therefore, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show his DD Form 214, Certificate of Release or Discharge from Active Duty, dated 27 February 2014, Block 16, Days Accrued Leave Paid, be amended to reflect “21.5” instead of “0”.
