RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01747 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect: 1. The Air Force Specialty Code (AFSC) in Item 11 be changed from 32152 to 32251F. 2. Award of the Meritorious Service Medal (MSM) (administratively resolved), Small Arms Expert Marksmanship Ribbon and Expert Marksmanship Ribbon (Note: The Expert Marksmanship Ribbon and SAEMR are the same). APPLICANT CONTENDS THAT: The primary AFSC is incorrect on his DD Form 214 and the contested medals are missing from his record. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 12 Oct 61, the applicant commenced his enlistment in the Regular Air Force, and on 1 Nov 87 he was retired and credited with 26 years and 19 days of active service. The remaining relevant facts pertaining to this application are contained in the memoranda prepared by the Air Force offices of primary responsibility (OPR), which are attached at Exhibits C and D. AIR FORCE EVALUATION: AFPC/DPSIC recommends denial of the request to change the AFSC 32152 on his DD Form 214 indicating there is no evidence of an error or an injustice. According to the Federal Interagency Database Online (FIDO), the AFSC 32251F was an active AFSC from 1 Dec 56 through 31 Oct 76, when it was inactivated and changed to 32152. A complete copy of the AFPC/DPSIC evaluation, with attachment, is at Exhibit C. AFPC/DPSID recommends denial for award of the SAEMR indicating there is no evidence of an error or an injustice. There was no evidence provided or located in the applicant’s records showing he qualified as an expert with the M-16 rifle or issued handgun. The SAEMR is awarded to all Air Force service members who, after 1 Jan 63, qualified as “expert” in small arms marksmanship with either the M-16 rifle or issued handgun. However, after 22 Jun 71, a bronze service star is worn on the service ribbon for those who qualified as an expert for both weapons. The applicant provided a copy of a special order for award of the SAEMR; however, his name was not listed on the order. The applicant’s entitlement to the MSM has been verified and his records will be administratively corrected to reflect the award. A complete copy of the AFPC/DPSID evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 29 Oct 15, for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely. However, it is in the justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. The applicant requests the AFSC on his DD Form 214 be changed to 32251F rather 32152. According to the Federal Interagency Database Online (FIDO) the AFSC 32251F was an active AFSC until it was inactivated and changed to 32152. Therefore, his AFSC is correct as listed on his DD Form 214. The applicant also requested award of the Small Arms Marksmanship Ribbon (SAEMR). While he provided a copy of a special order for award of the SAEMR, his name was not listed on the order. In addition, there was no evidence submitted or located to verify he qualified as expert for the SAEMR with either the M-16 or handgun. We note the Air Force OPR has determined the applicant’s entitlement for the Meritorious Service Award and will correct his records administratively. Therefore, we find no basis to recommend granting relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
