RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01799 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The additional five years spent in the Inactive Status List Reserve Section (ISLRS) from 27 August 2000 to 31 August 2005 be removed from his records. APPLICANT CONTENDS THAT: He should have been discharged from ISLRS after three years. In accordance with Air Force Instruction (AFI) 36-2115, Assignments within the Reserve Components, reserve officers generally remain assigned to ISLRS for three years after which time they should be screened for discharge. However, he remained in ISLRS for eight years (27 August 1997 – 31 August 2005) prior to being screened out in 2005. The additional five years has an effect on his current career as a captain in the Air National Guard (ANG). The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Air National Guard in the grade of captain. The remaining relevant facts pertaining to this application are described in the memoranda prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: ARPC/DPTT recommends approval. The applicant was reassigned from his Reserve unit to the Non-obligated Non-participating Ready Personnel Section (NNRPS) on 27 August 1995, and then transferred to ISLRS on 27 August 1997. He remained in ISLRS until he was involuntarily discharged on 31 August 2005. However, the applicant should have been screened for discharge after three years in ISLRS. He remained in ISLRS from 27 August 1997 to 31 August 2005, five years and four days after he should have been discharged. He was reappointed on 16 April 2010. A change in the effective date of his discharge from 31 August 2005 to 26 August 2000 will cause his pay date to change from 26 April 1990 to 30 April 1995 and his Total Federal Commissioned Service Date (TFCSD) changed from 26 November 1995 to 30 November 2000. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 15 September 2015 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he was discharged from all appointments effective 26 August 2000 rather than 31 August 2005.
