RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01845 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to include his Meritorious Service Medal (MSM), First Oak Leaf Cluster. APPLICANT CONTENDS THAT: Due to a severe backlog, several administrative errors, and numerous personnel changes within his unit, they failed to process and finalize his retirement decoration until approximately four years after his retirement from the Air Force Reserves. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 7 Mar 81. On 31 Aug 88, the applicant was furnished an Honorable discharge, and was credited with 7 years, 5 months, and 24 days of active service. The applicant’s DD Form 214 reflects the following Air Force Medals and/or Ribbons: - Meritorious Service Medal - Air Force Commendation Medal - Air Force Overseas Ribbon - Long Tour - Air Force Longevity Service Award - Small Arms Expert Marksmanship Ribbon with one Oak Leaf Cluster - Combat Readiness Medal with one Oak Leaf Cluster - Air Force Training Ribbon The applicant retired from the Air Force Reserves on 1 Nov 10. On 13 Nov 14, the applicant was awarded an MSM for meritorious service between 15 Jan 06 and 31 Oct 10. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFRC/DPTS recommends denial indicating there is no evidence of an error or an injustice. The MSM was awarded after the member’s DD Form 214 was issued and in accordance with AFI 36-3202, Separation Documents, Chapter 4, Table 4, Rule 23; Air National Guard and Reserve members: any authorized medals awarded after the effective date of a DD Form 214 should be added to any subsequent DD Form 214 issued. It should be noted that Reserve members must complete 90 continuous calendar days or more of active duty service to be issued a DD form 214 and in this case, the applicant did not meet that criteria after his 31 Aug 88 separation and therefore, never received a subsequent DD Form 214. While they cannot add the MSM to his DD Form 214, they have confirmed that the medal is reflected in his record within the Military Personnel Data System. A complete copy of the AFPC/DPTS evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 15 Sep 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
