RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-02067 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect the Nuclear Deterrence Operations Service Medal (NDOSM) with 3 Bronze Oak Leaf Clusters (BOLC). APPLICANT CONTENDS THAT: When he retired, the NDOSM was not yet updated in the personnel data system. As a result his DD Form 214 is not correct. He was assigned to four units eligible for award of the NDOSM so he should be awarded the NDSOM w/3BOLC on his DD Form 214. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 29 Jan 89, the applicant entered the Regular Air Force. On 31 Jan 15, the applicant was furnished an honorable discharge, and was credited with 26 years of active service of which 15 years, 7 months and one day was foreign service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The NDOSM was authorized on 27 May 14 to recognize direct support to nuclear deterrence operations. It may be awarded retroactively to 27 Dec 91 to fully qualified Airmen. It may be awarded to Airmen who, while assigned, attached, deployed or mobilized to a unit (Wing, Center or below), provided support to the Nuclear Enterprise for 120 consecutive or 179 nonconsecutive days and were subject to a Nuclear Inspection or performed duties in nuclear operations, nuclear weapons storage facilities, nuclear command, control, and communication, cyber surety, security, safety, transportation, maintenance, facility management and maintenance, explosive ordnance disposal, aircrew certified for support to nuclear operations, weapons loaders, warning and attack assessment, personnel reliability program management, or research, development and acquisition of nuclear systems. The medal is not awarded if the Airman's service has not been honorable. Service is the time period of the assignment (to include any extensions). Authorized Device: Oak Leaf Cluster and "N" device: An Oak Leaf Cluster is worn to denote subsequent awards. Subsequent awards are only authorized when a permanent change of station to a qualifying unit, as defined above, has occurred. This advisor was unable to verify award of the NDOSM w/3BOLC. A review of the applicant’s military personnel record indicates he received orders to the 91st Security Forces Group with reporting in Nov 12; however, when he arrived he was assigned to the 5th SFS. This action resulted from a permanent change of assignment (PCA) without a PCS and is verified by the applicant receiving an Enlisted Performance Report (EPR) with a reporting period from Jun 12 to Mar 13 at the 5th SFS. As a result of another PCA without PCS, the applicant was then assigned to the 91st SFG from the 5th SFS as evidenced by receiving an EPR with reporting period from Mar 13 to Mar 14 at the 91st SFG. Thus, the applicant’s assignments from 2012-2015 were the result of two PCAs without a PCS. The applicant contends upon his permanent change of assignment to a qualifying unit/location should qualify him for one award and then upon his permanent change of assignment from that very same unit he should qualify for another award; essentially the applicant is stating he should qualify for two awards of the NDOSM for one assignment at a qualifying unit/location. The applicant only served with a total of three qualifying units at three qualifying locations for award of the NDOSM, with N device, with two Bronze Oak Leaf Clusters. Accordingly, the NDOSM w/2BOLC should have been awarded during the applicant's service from 31 Jan 89 to 31 Jan 15. Upon final board decision, the applicant's official military personnel record will be administratively corrected. The NDOSM w/2BOLC is not currently available. The medal is currently scheduled to be available late 2015. At that time, the medal will be shipped to the applicant. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 Oct 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant granting the applicant’s request for the Nuclear Deterrence Operations Service Medal with 3 Bronze Oak Leaf Clusters (NDOSM w/3BOLC). We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. However, in reviewing the applicant’s military personnel record, the OPR was able to verify award of the NDSOM w/2BOLC is appropriate and AFPC/DPSOR is taking administrative action to correct the applicant’s military record. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
