RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-02142 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect he was awarded the Bronze Star Medal. APPLICANT CONTENDS THAT: He earned the Bronze Star Medal, and was awarded the medal just after he was released from active duty, but it is not reflected in his records. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 17 Jun 66. On 16 Apr 70, the applicant was released from active duty, furnished an honorable discharge, and was transferred to the Air Force Reserve. He was credited with three years, eleven months, and twelve days of active service, including eleven months, and twenty-six days of foreign service. On 22 Mar 72, the applicant was relieved from his assignment with the Air Force Reserve and was honorably discharged. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice warranting award of the Bronze Star Medal. The Bronze Star Medal is awarded to a person in any branch of the military service who, while serving in any capacity with the Armed Forces of the United States on or after 7 Dec 41, shall have distinguished himself or herself by heroic or meritorious achievement or service, not involving participation in aerial flight, in connection with military operations against an armed enemy. The award recognizes acts of heroism performed in ground combat if they are of lesser degree than that required for the Silver Star. It also recognizes single acts of merit and meritorious service if the achievement or service is of a lesser degree than that deemed worthy of the Legion of Merit; but such service must have been accomplished with distinction. After a thorough review of the applicant's military personnel record, they were unable to verify award of the Bronze Star Medal. Also, this request was not filed in a timely manner and should be disapproved. Notwithstanding the above, they were able to determine that the below Air Force Medals and/or Ribbons should have been awarded during the applicant's service from 17 Jun 66 to 16 Apr 70 and were not reflected in his records. Upon final board decision, administrative correction of the applicant's official military personnel record will be completed by AFPC/DPSOR: 1. Air Force Outstanding Unit Award with Valor (AFOUA w/V). 2. Vietnam Service Medal with four Bronze Service Stars (VSM w/4BSS). 3. Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P). A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 Oct 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the AFPC/DPSID and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice regarding award of the Bronze Star Medal. We note the applicant’s contention that he earned the Bronze Star Medal, and was awarded the medal just after he was released from active duty, but it is not reflected in his records. However, there is no documentation in the applicant’s record, such as a special order or recommendation for award of the Bronze Star, nor was any provided to verify the applicant was recommended for or awarded the Bronze Star Medal. Notwithstanding, we note that AFPC/DPSID’s research revealed the Air Force Outstanding Unit Award with Valor (AFOUA w/V), Vietnam Service Medal with four Bronze Service Stars (VSM w/4BSS), and Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P), should have been awarded during the applicant’s service from 17 Jun 66 to 16 Apr 70, but were not reflected in his records. Additionally noted is that upon final Board determination, AFPC/DPSOR will administratively correct the applicant’s military personnel record to reflect these awards and decorations. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
