RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-02184 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to show he transferred his Post-9/11 GI Bill Education Benefits (TEB) to his dependents on 4 Oct 11 (original application date), or 3 Jul 13, when he reenlisted for five years. APPLICANT CONTENDS THAT: He was not notified his 4 Oct 11, TEB application was rejected because he did not have the required retainability. He was promoted and reenlisted 3 Jul 13 for five years and applied again for TEB. In 2014 he discovered his TEB was still pending TEB approval from 2011, and per instruction of the wing education office he filled out and uploaded VA Form 1990, Application for Family Member to use Transferred Benefits. Upon inquiry with the Department of Veteran’s Affairs (DVA), he found out he still did not have TEB approval. He has tried several times to get his TEB approved and has not been successful. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 12 Jan 95. On 13 Feb 09, the applicant reenlisted for four years and five weeks. On 3 Jul 13, the applicant reenlisted for five years. On 22 Jun 15, a six month extension to the applicant’s 3 Jul 13 enlistment for five years for purposes of TEB was approved. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIT recommends denial indicating there is no evidence of an error or an injustice. Right Now Technology (RNT) records revealed an email was sent to the applicant by the Total Force Service Center (TFSC) on 18 Oct 11 informing him the TEB application had expired because he did not have retainability. Additionally, records revealed an Air Force Personnel Center Education Services Adviser sent an audit email on 11 Jun 13 informing the applicant of actions required for TEB approval. The applicant reapplied and was approved for TEB effective 10 Jun 15. A complete copy of the AFPC/DPSIT evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 5 Oct 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. The Board noted the OPR’s evaluation indicated the applicant reapplied and was approved for TEB effective 10 Jun 15. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
