RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-02347 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His active duty orders for the period ending 4 April 2014 be extended to 8 July 2014 for Medical Continuation (MEDCON). APPLICANT CONTENDS THAT: His Title 10 orders expired despite a Line of Duty (LOD) injury. In October 2013, he was injured while deployed to Al Dhafra AB, United Arab Emirates. On 17 February 2014, his deployed clinic advised him an MRI could not be done because there was no trauma. Upon his return from deployment, he had an MRI on 9 April 2014 which revealed two meniscal tears in his right knee. The injury was determined in the LOD and he had surgery on 19 May 2014. He was not extended on active duty despite his in the LOD injury. In support of his request, the applicant provides copies of his AF IMT 348, Line of Duty Determination, dated 1 May 2014, National Guard Bureau (NGB) Order Number 15236, dated 4 February 2013; AF Form 469, Duty Limiting Condition Report, dated 21 May 2014 and other various documents associated with his request. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently in the Air National Guard serving in the grade of Staff Sergeant (SSgt, E-5). The applicant’s DD Form 214, Certificate of Release or Discharge from Active Duty, reflects he entered this period of active duty on 26 July 2013 and was honorably released from active duty on 4 April 2014 with a narrative reason for separation of “Release due to demobilization.” Item 18, Remarks, states “Member on AD in support of Operation Enduring Freedom in accordance with Title 10, USC 12302 from 26 Jul 2013 to 4 Apr 2013 [sic].” AF IMT 348 dated 1 May 2014, reflects the applicant’s injury was found in the LOD on 13 May 2014. The remaining relevant facts pertaining to this application is described in the memorandum prepared by the Air Force Office of Primary Responsibility (OPR), which is included at Exhibits C. AIR FORCE EVALUATION: AFPC/DPFA recommends approval for MEDCON orders, military pay and points for the period of 4 April to 8 July 2014. The applicant was injured in the LOD while on Partial Mobilization (PM) orders from 26 July 2013 to 4 April 2014. The AF Form 469 reflects duty/mobility restrictions during the time the applicant states. Per the August 2012, Secretary of the Air Force MEDCON policy, MEDCON eligibility requires a LOD determination and a finding by a credentialed military health care provider highlighting the service member has an unresolved health condition requiring treatment. The applicant does not indicate if he applied for MEDCON; however, the request is valid and he would have been eligible had he applied for MEDCON. A complete copy of the AFPC/DPFA evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 November 2015 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force OPR and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show he was not released from active duty on 4 April 2014 but was continued on active duty until 8 July 2014, for the purpose of medical continuation in accordance with Title 10, U.S.C. § 12301(h).
