2. The applicant requests, in effect, that she be granted a terminal leave promotion from First Lieutenant to Captain and her report of separation be corrected accordingly. 3. The applicant’s military records were lost or destroyed in the National Personnel Records Center fire of 1973. Information herein was obtained from alternate sources. 4. She was born on 14 June 1907. She entered active duty on 19 August 1942 as a Second Lieutenant in the Army Nurse Corps. She was promoted to First Lieutenant on 31 August 1943. She arrived in the European Theater on 18 November 1944 and departed the Theater on 28 November 1945. She was relieved from active duty on 24 February 1946. 5. On 29 April 1946, the applicant was notified that she apparently had been eligible for promotion upon separation from the Service in accordance with War Department Circular 10, dated 11 January 1946 but since she had not been promoted coincident with her relief from active duty, she could be promoted by The Adjutant General only. 6. On 31 October 1946, The Adjutant General’s Office promoted her to Captain effective that date. 7. War Department Circular 10 dated 11 January 1946 provided for the promotion of officers below the grade of colonel, and not members of the Regular Army, coincident with processing for separation from active duty. A First Lieutenant being relieved from active duty was eligible for promotion to Captain provided he or she met the criteria of completion of 18 months on active duty in the grade of First Lieutenant, with an efficiency index of 40 or above. Commanders, including commanders of separation centers, were authorized to promote officers under the provisions of this directive as an incident of relief from active duty. Promotions after officers had reverted to inactive status would be made by the Adjutant General only. CONCLUSIONS: 1. The applicant was promoted to First Lieutenant on 31 August 1943. She was relieved from active duty on 24 February 1946, 29 months later, with an efficiency index of over 40. This made her eligible for promotion to Captain coincident with her separation. 2. The separation center erred in not promoting her to Captain in accordance with War Department Circular 10. When the error was discovered, The Adjutant General’s Office promoted her, but not until 31 October 1946. 3. In view of the foregoing, it would be in the interest of justice to correct the applicant’s records as recommended below. RECOMMENDATION 1. That the order dated 31 October 1946, promoting the applicant to Captain effective that date, be revoked. 2. That all of the Department of the Army records pertaining to the applicant show that she was promoted to Captain on 24 February 1946 in accordance with War Department Circular 10 dated 11 January 1946.
