That the effective date of his reserve promotion be changed from 17 February 1993 to 20 June 1992 and that he be given the pay difference between a captain and a major from 20 June 1992 to 17 February 1993. 3. Evidence of record shows the applicant, a Reserve officer assigned to the USAR Control Group (REINF), was notified by the US Army Reserve Personnel Center (ARPERCEN), St. Louis, MO on 8 May 1992 that he was selected for promotion to major with a promotion eligibility date (PED) of 20 June 1992. The notification letter stated that promotion orders would be issued in approximately 30 days. 4. Orders sent to the applicant to attend drill in October 1992 were in the grade as a captain. He notified ARPERCEN of the error, however, orders were not issued until 14 May 1993 which reflected a PED of 20 June 1992 and an effective date of promotion of 17 February 1993. He was paid as a captain for drills attended between 20 June 1992 and 17 February 1993. CONCLUSIONS: 1. The evidence of record confirms that the applicant was promoted to major on 20 June 1992. 2. The promotion orders to major were not published in a timely manner and therefore, created an unjust error in the applicant’s military records. 3. The applicant’s promotion eligibility date was 20 June 1992, his effective date of promotion was 20 June 1992 and that he should be paid as a major after 20 June 1992. 4. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below. RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing: a. that the promotion eligibility date and effective date of promotion to major of the individual concerned was 20 June 1992; b. that any USAR participation 20 June 1992 was with pay and benefits as a major.
