APPLICANT REQUESTS:  That he be awarded the Army of Occupation Medal (Berlin) and the Armed Forces Expeditionary Medal.

APPLICANT STATES:  In effect, that he served in West Berlin from 2 February 1961 until 27 August 1962.

EVIDENCE OF RECORD:  The applicant’s military records show:

He was inducted into the Army on 8 September 1960.  He was assigned to Company D, 1st Armored Rifle Battalion, 54th Infantry, Germany, Army Post Office (APO) 176 from 3 February 1961 - 27 August 1962 as a rifleman, armored personnel carrier driver and track vehicle mechanic.

The applicant’s separation physical shows he was treated at U.S. Army Hospital Bad Cannstatt Medical Clinic #8, Heilbronn, APO 176.  His dental records show he was treated at Dental Clinic #3, Heilbronn, APO 176.

Records at the Center for Military History show the 1st Armored Rifle Battalion, 54th Infantry was permanently stationed in Heilbronn during the period February 1961 through August 1962.  They have no record of the unit or individuals from the unit being deployed to Berlin during this period.

Army Regulation 600-8-22 provides policy, criteria and administrative instructions concerning individual military decorations.  In pertinent parts, it states that the Armed Forces Expeditionary Medal is authorized for U.S. military operations, under certain service criteria, for Berlin from 14 August 1961 to 1 June 1963 and the Army of Occupation Medal for 30 consecutive days at a normal post of duty (as contrasted to temporary duty or detached service) while assigned to Berlin between 9 May 1945 and 2 October 1990.

DISCUSSION:  Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1.  In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust.  The applicant has failed to submit evidence that would satisfy the aforementioned requirement.

2.  Evidence in the records show the applicant’s unit was located in Heilbronn.  Evidence in the Center of Military History’s records show his unit was permanently located in Heilbronn during the period in question and has no record of the unit being ordered to Berlin.

3.  The applicant has supplied no evidence to support his contention that he was in Berlin during his tour in Germany.

4.  In view of the foregoing, there is no basis for granting the applicant’s request.

DETERMINATION:  The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
