	The applicant and counsel if any, did not appear before the Board.

	The Board considered the following evidence:

FINDINGS:

1.  The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2.  The applicant requests that his DD Form 214 be corrected to show his rank as major instead of captain.

3.  The applicant states he was promoted before separation and his rank was major at the time of his separation from active duty.

4.  The applicant’s military records show that he entered the Regular Army effective 19 February 1987 and served as a Medical Service officer.

5.  He was promoted to major, pay grade 0-4, effective 1 February 1998.

6.  His request for unqualified resignation for miscellaneous reasons was approved and he was discharged on 13 February 1998.

7.  He was honorably discharged in the rank of captain with 10 years, 11 months and 25 days of net active service for this period.

8.  His DD Form 214 shows his rank of captain in item 4a, his pay grade as 0-3 in item 4b, and his date of rank as 1 March 1991 in item 12h.

CONCLUSIONS:

1.  The applicant’s DD Form 214 is currently in error and should be corrected as he has requested.

2.  The evidence of record clearly shows he was promoted to major effective 
1 February 1998, and that was his rank upon his discharge on 13 February 1998.

3.  In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing on the DD Form 214 of the individual concerned that he was discharged on 13 February 1998 as a major in Item 4a, pay grade 0-4 in Item 4b, and effective date of pay grade of 1 February 1998 in Item 12h.
