Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, award of the Combat Parachutist Badge. 2. The applicant states, in effect, he was awarded the Combat Parachutist Badge, but the orders for the award were not released until after his discharge from the Army. He would now like this award added to his record and separation document (DD Form 214). 3. The applicant provides a copy of United States Army Human Resources Command (HRC) Orders Number 037-01, dated 6 February 2004, HRC Memorandum, dated 6 February 2004; and Manifest, dated 10 February 2004 in support of his application. CONSIDERATION OF EVIDENCE: 1. The applicant’s records show he enlisted into the Army and entered active duty on 26 January 2000. He was trained in, awarded and served in military occupational specialty 11B (Infantryman), and the highest rank he attained while serving on active duty was specialist (SPC). 2. Orders Number 240-438, issued by Headquarters, United States Army Infantry Center, Fort Benning, dated 27 August 2000, awarded the applicant the Parachutist Badge. 3. The applicant’s records contain a copy of an Army Commendation Medal (ARCOM) certificate that show he was awarded the ARCOM in Headquarters, 1st Brigade, 82nd Airborne Division, Fort Bragg, North Carolina Permanent Orders Number 330-02, for meritorious service while assigned to the 504th Parachute Infantry Regiment from 5 October 2000 to 2 December 2003. 4. On 25 January 2004, the applicant was honorably separated at the expiration of his term of service (ETS). The DD Form 214 he was issued shows he completed a total of 4 years of active military service. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) shows he earned the following awards during his tenure on active duty: National Defense Service Medal; Army Service Ribbon, Expert Marksmanship Qualification Badge with Rifle Bar, Combat Infantryman Badge, Expert Infantryman Badge, and Parachutist Badge. 5. HRC Orders Number 037-01, dated 6 February 2004, awarded the applicant Assault Landing Credit for participation in a parachute assault landing into enemy controlled territory on 25 February 2003. 6. The applicant provides a manifest that confirms he participated in the combat parachute jump with his unit, Company B, 3rd Battalion, 504th Parachute Infantry Regiment near Chahar Borjak, Nimruz Province, Afghanistan on 25 February 2003. 7. Army Regulation 600-8-22 (Military Awards) states that a bronze service star is authorized to be worn on the Parachutist Badge to denote a Soldier's participation in a combat parachute jump. Orders are required to confirm award of these badges. 8. Army Regulation 670-1 describes the placement of stars on Parachute Badges. It states, in pertinent part, that a Soldier's combat parachute jump credit is tied directly to the combat assault credit decision for the unit to which the Soldier is attached or assigned at the time of the assault. Each Soldier must physically exit the aircraft to receive combat parachute jump credit and the Parachutist Badge with bronze service star. 9. Executive Order Number 13289, dated 12 March 2003, established two new medals for service in the Global War on Terrorism (GWOT). They are the Global War on Terrorism Expeditionary Medal (GWOTEM) and the Global War on Terrorism Service Medal (GWOTSM). These medals are awarded to recognize all members of the Armed Forces of the United States serving in, or in support of GWOT operations on or after 11 September 2001. 10. The guidance specifies that to be eligible for the GWOTEM, a Soldier must be assigned, attached or mobilized to a unit participating in designated operations for 30 consecutive days or 60 non-consecutive days in designated Areas of Expedition (AOE), or meet one of the following criteria: (a) be engaged in actual combat against the enemy and under circumstances involving grave danger of death or serious bodily injury from enemy action, regardless of the time in the area; (b) is killed or wounded/injured requiring medical evacuation from the AOE; (c) Soldiers participating as a regularly assigned air crew member flying sorties into, out of, within, or over an AOE in direct support of operations Enduring Freedom and/or Iraqi Freedom, each day that one or more sorties are flown counts as one toward the 30 consecutive or 60 non-consecutive day requirement. 11. The GWOTEM guidance further states that under no conditions will any Soldiers in the United States receive the GWOTEM. Only Soldiers serving in an operationally deployed status in a designated AOE are eligible for the GWOTEM. The Bronze Arrowhead Device, which denotes participation in a combat parachute jump, helicopter assault landing, combat glider landing, or amphibious assault landing, will be worn on the GWOTEM. 12. The GWOTSM is authorized to be awarded to Soldiers who have participated in or served in support of GWOT operations outside a designated AOE on or after 11 September 2001. Initial award of the GWOTSM will be limited to airport security operations from 27 September 2001 through 31 May 2002, who supported operations Noble Eagle, Enduring Freedom and Iraqi Freedom. All Soldiers on active duty, including Reserve Component Soldiers mobilized and National Guard Soldiers activated on or after 11 September 2001, having served 30 consecutive days or 60 non-consecutive days, are authorized the GWOTSM. DISCUSSION AND CONCLUSIONS: 1. The applicant's contention that he is entitled to award of the Combat Parachutist Badge based on his service was carefully considered and found to have merit. The evidence of record confirms he participated in a combat parachute jump, for which his unit received assault landing credit. As a result, he is authorized a bronze service star with his Parachutist Badge, to denote his participation in a combat parachute jump. 2. The evidence of record also confirms the applicant served on active duty from 26 January 2000 through 25 January 2004, and that he served in Afghanistan, authorized AOE, in support of Operation Enduring Freedom, from 12 January 2003 through 16 August 2003. Therefore, he is entitled to both the GWOTSM and GWOTEM. Further, based on the assault landing credit awarded his unit for the combat parachute jump he participated in on 25 February 2003, he is also authorized a bronze arrowhead with his GWOTEM. 3. Further, the record confirms the applicant was awarded the ARCOM, for meritorious service while assigned to the 504th Parachute Infantry Regiment from 5 October 2000 to 2 December 2003. Therefore, it would also be appropriate to add this award to his separation document at this time.
