RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 13 April 2006 DOCKET NUMBER: AR20050010870 I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. Mr. Carl W. S. Chun Director Ms. Phyllis B. Mackey Analyst The following members, a quorum, were present: Mr. Richard T. Dunbar Chairperson Mr. Patrick H. McGann, Jr. Member Mr. Qawiy A. Sabree Member The Board considered the following evidence: Exhibit A - Application for correction of military records. Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his Certificate of Release or Discharge from Active Duty, DD Form 214, to reflect time served in Iraq. 2. The applicant states, in effect, that his DD Form 214 does not reflect the time he served in Iraq. 3. The applicant provides a copy of his DD Form 214 Worksheet, in support of his request. CONSIDERATION OF EVIDENCE: 1. The applicant is requesting correction of an alleged error or injustice which occurred on 29 August 2004, the date of his separation from the active Army. 2. The applicant’s record shows that he enlisted in the Regular Army (RA) on 11 September 2000. He served for 3 years, 11 months and 19 days. He was honorably released from Active Duty (AD) in accordance with AR 635-200, Chapter 4, (Completion of Required Active Service) on 29 August 2004. 3. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), of the applicant’s DD Form 214 shows he was awarded the National Defense Service Medal, Army Service Ribbon, and the Global War on Terrorism Service Medal, while he served on AD. 4. Item 13, of the applicant’s DD Form 214, does not show the Global War on Terrorism Expeditionary Medal. This medal is awarded to Soldiers who deployed to Iraq and who met the criteria for the award. 5. In his application, the applicant provided no specific information pertinent to his service in Iraq-date of deployment, date of redeployment, unit served with and place the applicant was stationed in Iraq. 6. The applicant provided no orders to show he was ordered to perform duty on either a permanent or on a temporary duty basis in Iraq. 7. The applicant provided no leave and earnings statements to show he was paid hostile fire or imminent danger pay while he allegedly served in Iraq. 8. The applicant’s Enlisted Records Brief (ERB) is absent any indication of the applicant’s alleged service in Iraq. 9. The applicant does not provide any additional documentation to substantiate his request to be credited for time served in Iraq. DISCUSSION AND CONCLUSIONS: 1. The applicant’s DD Form 214 shows his awards and decorations. Among these awards are none that would indicate service in Iraq. 2. There is no documentation, i.e., deployment orders; redeployment orders; assignment or attachment orders to a unit that served in Iraq during the timeframe that the applicant is requesting credit for time served in Iraq. The Global War on Terrorism Expeditionary Medal, which is awarded to Soldiers who deployed to Iraq in support of the Global War on Terrorism is not shown on his ERB. There is no indication that he actually physically served in Iraq; therefore, he is not entitled to have his DD Form 214 corrected to show he performed service in Iraq. 3. The applicant has not provided any supporting documents to justify a correction to his DD Form 214. BOARD VOTE: ________ ________ ________ GRANT FULL RELIEF ________ ________ ________ GRANT PARTIAL RELIEF ________ ________ ________ GRANT FORMAL HEARING __QS____ __RTD__ ___PM __ DENY APPLICATION BOARD DETERMINATION/RECOMMENDATION: The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. ____Richard T.
