The applicant requests, in effect, that his DD Form 214 (Certificate of Release or Discharge From Active Duty) which was issued at the time of his discharge on 4 July 2003 be corrected to show the correct date he entered active duty (AD) as a commissioned officer in Item 12a (Date Entered AD This Period), and that Item 12c (Net Active Service This Period) be adjusted accordingly. 2. The applicant essentially states that Item 12a of his DD Form 214 that was issued at the time of his discharge on 4 July 2003 incorrectly shows 4 January 1991, the date he entered AD as an enlisted Soldier instead of 25 September 1998, the date he entered AD as a commissioned officer. 3. The applicant provides his DD Form 214 that was issued at the time of his discharge on 24 September 1998 in order to accept a commission, and the DD Form 214 that was issued at the time of his discharge on 4 July 2003 in support of this application. CONSIDERATION OF EVIDENCE: 1. The applicant is requesting correction of an alleged error which occurred on 4 July 2003, the date of his discharge as a commissioned officer. The application submitted in this case is dated 31 May 2006. 2. Item 12a of the applicant’s DD Form 214 that was issued at the time of his discharge on 24 September 1998 shows that he entered AD as an enlisted Soldier on 4 January 1991. 3. The applicant was discharged as an enlisted Soldier on 24 September 1998, and entered active duty as a commissioned officer on 25 September 1998. However, Item 12a of the applicant’s DD Form 214 that was issued at the time of his discharge as a commissioned officer on 4 July 2003 incorrectly shows that he also entered AD as a commission officer on 4 January 1991; the date he actually entered AD as an enlisted Soldier. 4. The applicant served as a commissioned officer from 25 September 1998 to 4 July 2003, which is a total of 4 years, 9 months, and 10 days. However, Item 12c of the applicant’s DD Form 214 that was issued at the time of his discharge as a commissioned officer incorrectly shows that he served as a commissioned officer for 12 years, 6 months, and 1 day, which is actually the applicant’s cumulative time spent on AD as both an enlisted Soldier and a commissioned officer. 5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214, including block 12 (Record of Service). It states, in pertinent part, that in item 12a (Date entered active duty this period) enter the beginning date of the continuous period of active duty for issuance of the DD Form 214, for which a DD Form 214 was not previously issued. It also states that in item 12b (Separation date this period) enter the Soldier’s transition date. It further states that in item 12c (Net service this period) enter the amount of service this period, computed by subtracting item 12a from item 12b. DISCUSSION AND CONCLUSIONS: 1. The applicant contends that his DD Form 214 which was issued at the time of his discharge on 4 July 2003 should be corrected to show the correct date he entered AD as a commissioned officer in Item 12a, and that Item 12c should be adjusted accordingly. 2. It is clear that the applicant’s DD Form 214 that was issued at the time of his discharge as a commissioned officer incorrectly shows that he entered AD as a commissioned officer on 4 January 1991, when it should have shown that he entered AD as a commissioned officer on 25 September 1998. That error, in turn, caused Item 12c of that form to incorrectly show that he served 12 years, 6 months, and 1 day as a commissioned officer, when it should have shown that he served 4 years, 9 months, and 10 days as a commissioned officer. Therefore, his DD Form 214 issued on 4 July 2003 should be corrected accordingly.
