Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his records to show award of the Afghanistan Campaign Medal and the Bronze Star Medal. 2. The applicant states that the paperwork for award of the Afghanistan Campaign Medal and the Bronze Star Medal were not available at the time of his release from active duty. He states that he now has the paperwork and the awards have caught up with him. He states he has original copies of his assignment orders to Afghanistan for 12 months for award of the Afghanistan Campaign Medal and the DA Form 638 (Recommendation for Award) for award of the Bronze Star Medal. 3. The applicant provides a copy of active duty orders; his deployment orders to Afghanistan; his separation orders from active duty; his award certificate for the Bronze Star Medal; and his DA Form 638 for award of the Bronze Star Medal. CONSIDERATION OF EVIDENCE: 1. The applicant has served in support of Operation Enduring Freedom. 2. After having had prior enlisted service in the Regular Army and the Army National Guard, the applicant was appointed as a second lieutenant in the U.S. Army Reserve (USAR) on 13 May 2000. He was transferred from the USAR Control Group (Annual Training) to the USAR Control Group (Reinforcement) on 20 June 2000. 3. The applicant was released from the USAR Control Group (Reinforcement) and appointed as a second lieutenant in the Texas Army National Guard on 8 August 2000. 4. He was ordered to active duty in support of Operation Enduring Freedom on 7 March 2005. He served in Afghanistan from 6 May 2005 through 8 May 2006. 5. The applicant was awarded the Bronze Star Medal for meritorious service from 10 May 2005 to 7 May 2006 based on Headquarters, Command Joint Task Force 76 Permanent Order Number 133-009, dated 13 May 2006. 6. The applicant was released from active duty on 19 May 2006 at the completion of his required active service. His DD Form 214 for the period ending 19 May 2006 shows, in part, the Bronze Star Medal with “V” Device and the Global War on Terrorism Service Medal as authorized awards. 8. Army Regulation 600-8-22 (Military Awards) states that individuals authorized the Afghanistan Campaign Medal must have served in direct support of Operation Enduring Freedom (OEF). The area of eligibility encompasses all land area of the country of Afghanistan and all air spaces above the land. The Afghanistan Campaign Medal period of eligibility is on or after 24 October 2001 to a future date to be determined by the Secretary of Defense or the cessation of OEF. 9. Army Regulation 600-8-22 states, in pertinent part, that the first oak leaf cluster is awarded to denote the second and succeeding awards of certain decorations, among which is the Bronze Star Medal. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant served in Afghanistan in support of Operation Enduring Freedom from 6 May 2005 through 8 May 2006. Based on his service in Afghanistan, he is entitled to award of the Afghanistan Campaign Medal. Therefore, this medal should be added to his DD Form 214. 2. The applicant’s DD Form 214 for the period ending 19 May 2006 currently reflects award of the Bronze Star Medal with “V” Device. Permanent orders show he was awarded a second award of the Bronze Star Medal for meritorious service from 10 May 2005 to 7 May 2006. Therefore, his DD Form 214 should be amended to show the Bronze Star Medal with “V” Device (First Oak Leaf Cluster).
