Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, that item 9 (Command to Which Transferred) on his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show “Troop A, 2nd Squadron, 106th Cavalry, (WX4ZA0), 825 Reynolds Street, Pontiac, IL 61764.” 2. The applicant states, in effect, that he enlisted in Army National Guard (ARNG) after he completed his active duty service and that he wants his DD Form 214 to state that he is in the Army National Guard. 3. The applicant provides his discharge orders, dated 21 June 2006; a memorandum of assignment, dated 6 July 2006; a copy of his DD Form 214; and his ARNG enlistment contract. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 27 July 2004 and trained as a cavalry scout. 2. A DD Form 4/1 (Enlistment/Reenlistment Document), dated 6 July 2006, shows the applicant enlisted in the ARNG for a period of 5 years and 25 days. The effective date of his Reserve Component enlistment is the day after his discharge from the Regular Army. 3. Headquarters, III Corps and Fort Hood Orders 172-0118, dated 21 June 2006, show the applicant’s date of release from active duty unless changed or rescinded was 26 July 2006 and that he would be assigned to USAR CON GR (REINF) [U.S. Army Reserve Control Group (Reinforcement)] 1 Reserve Way, St. Louis, MO 63132. 4. A memorandum of assignment, dated 6 July 2006, amended Headquarters, III Corps and Fort Hood Orders 172-0118, dated 21 June 2006, to show the applicant would be assigned to Troop A, 2nd Squadron, 106th Cavalry, (WX4ZA0), 825 W. Reynolds Street, Pontiac, IL 61764. 5. The applicant was released from active duty on 26 July 2006. 6. Item 9 on the applicant’s DD Form 214 shows the entry, “USAR CON GP (ANLTNG) [Annual Training] 1 RESERVE WAY, ST LOUIS, MO 63121.” 7. Army Regulation 635-5 establishes the standardized policy for preparing and distributing the DD Form 214. For entries required in item 9, the regulation refers to Rule 1 of Table 2-1 (DD Form 214, Item 9 Entry Determinations). This rule states when the member is released from active duty with a remaining statutory Service or contractual obligation and the Soldier’s status is (1) return to ARNG, then the ARNG of the applicable State or Territory will be entered in item 9; (2) transfer or return to USAR with no specific troop program unit (TPU) assignment, then the appropriate USAR Control Group will be entered in item 9; or (3) transfer or return to USAR with a specific TPU assignment, then the designation of the TPU to which assigned will be entered. DISCUSSION AND CONCLUSIONS: 1. Item 9 on the applicant’s DD Form 214 is incorrect, although there is no regulatory cite for his particular situation. Evidence of record shows the applicant enlisted in the Regular Army and was released from active duty on 26 July 2006. Evidence of record also shows that he enlisted in the Army National Guard effective 27 July 2006 and was assigned to Troop A, 2nd Squadron, 106th Cavalry, (WX4ZA0), 825 Reynolds Street, Pontiac, IL 61764 following his release from active duty. 2. As an exception to policy, it would be appropriate to amend item 9 on his DD Form 214 to show that he was transferred to Troop A, 2nd Squadron, 106th Cavalry, (WX4ZA0), 825 Reynolds Street, Pontiac, IL 61764.
