Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Iraq Campaign Medal, the Combat Action Badge, and the Meritorious Service Medal. 2. The applicant states that the awards were issued after his separation from the Army but he met all the qualifications and criteria for these awards. 3. The applicant provides orders for the Meritorious Service Medal and a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. The applicant served in Operation Iraqi Freedom. 2. The applicant requested correction of his records to show award of the Combat Action Badge. Requests for award of the Combat Action Badge must be forwarded to the Commanding General, U.S. Army Human Resources Command, ATTN: AHRC-PDO-PA, Alexandria, Virginia 22332-0471. This award may be requested by letter. All requests must contain the following: (1) assignment, attachment or operational control orders; (2) a copy of the Soldier's Enlisted Record Brief or DA Form 2-1; (3) a copy of the chain of command endorsement; (4) a one-page narrative description of the qualifying incident; (5) a certified copy of the DD Form 214 (Certificate of Release or Discharge from Active Duty); and (6) supporting documentation. The applicant is required to exhaust all administrative remedies; accordingly, there will be no further discussion of this issue. 3. The applicant enlisted on 25 March 1999 and trained as a Bradley linebacker crewmember and combat engineer. He served in Iraq from 8 March 2004 to 9 December 2004 and was honorably discharged on 5 July 2005. 4. The applicant’s DD Form 214 shows the Army Lapel Button, the Army Commendation Medal (2nd Award), the Army Achievement Medal (4th Award), the Global War on Terrorism Expeditionary Medal (GWOTEM), the Global War on Terrorism Service Medal, the Army Good Conduct Medal (2nd Award), the National Defense Service Medal, the Korea Defense Service Medal, the Noncommissioned Officer’s Professional Development Ribbon with Numeral “2,” the Army Service Ribbon, the Overseas Service Ribbon, the Expert Marksmanship Qualification Badge with Grenade Bar, the Driver and Mechanic Badge with Driver-T Bar, and the Driver and Mechanic Badge with Driver-W Bar as authorized awards. 5. Headquarters, III Corps and Fort Hood Permanent Order Number A-111-2, dated 21 April 2005, shows the applicant received the Meritorious Service Medal. 6. On 21 February 2007, the applicant was notified by separate correspondence that he was eligible for the GWOTEM and the Iraq Campaign Medal for qualifying service in Iraq; however, he could only receive one of these service medals in recognition of his service in Iraq. He was instructed to notify the Board in writing of his decision to receive the Iraq Campaign Medal or have the GWOTEM remain on his DD Form 214. He was also informed that if he did not respond in writing with his decision then the GWOTEM would remain on his DD Form 214. The applicant did not respond within the given time frame. Therefore, this portion of the applicant’s request will not be discussed further in these Proceedings. DISCUSSION AND CONCLUSIONS: Orders show the applicant received the Meritorious Service Medal. Therefore, he is entitled to correction of his records to show award of the Meritorious Service Medal.
