Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that 16 correspondence course retirement points earned on 2 July 2003 be applied to retirement year ending (RYE) 1 July 2003. 2. The applicant states, in effect, that her retirement year beginning and end dates were changed after 2003 which resulted in the loss of one good year (2002/2003) for retirement purposes. She contends that had she been using the revised retirement year accounting dates at the time she earned the 16 correspondence course retirement points, she would have ensured that she completed the course in time to count for her 2002/2003 retirement year. 3. The applicant provides three Chronological Statements of Retirement Points prepared on 31 July 2003, 4 December 2003, and 30 June 2005; and a Defense Acquisition University transcript. CONSIDERATION OF EVIDENCE: 1. The applicant was commissioned in the Regular Army on 28 May 1986 and entered active duty. On 1 July 1997, she was released from active duty and transferred to the U.S. Army Reserve (USAR). 2. The applicant’s Chronological Statement of Retirement Points, prepared on 31 July 2003, shows that her RYE was changed from 27 May to 1 July in 1997. 3. The applicant’s Chronological Statement of Retirement Points, prepared on 4 December 2003, also shows that her RYE was changed from 27 May to 1 July in 1997. 4. The applicant’s Chronological Statement of Retirement Points, prepared on 30 June 2005, shows that her RYE was changed back to 27 May in 1998 (after a USAR/Regular Army split year from 27 May 1997/1 July in 1997 and 2 July 1997/28 May 1998). This statement also shows that she earned 63 extension (i.e. correspondence) course points for retirement year 28 May 2003 to 27 May 2004, for a total of 96 retirement points. 5. In the processing of this case, a staff advisory opinion was obtained from the Regional Personnel Actions Division, U.S. Army Human Resources Command, St. Louis, Missouri. The opinion points out that the applicant was commissioned in the Regular Army on 28 May 1986, with service until 1 July 1997. The applicant has had no break in service since transferring to the USAR; therefore, her RYE is 27 May. 6. The advisory opinion was provided to the applicant on 28 March 2007 for comment or rebuttal. The applicant did not respond within the given time frame. DISCUSSION AND CONCLUSIONS: 1. It is noted that, notwithstanding the advisory opinion, two retirement point statements show the applicant’s RYE was changed from 27 May to 1 July. Not until the retirement point statement dated 30 June 2005 were her RYEs again shown as 27 May. 2. Nevertheless, the applicant requested that 16 correspondence course retirement points earned on 2 June 2003 be added to “retirement year 2002/2003.” Retirement point statement, dated 30 June 2005, shows she earned 63 extension course points for retirement year 28 May 2003 to 27 May 2004, for a total of 96 retirement points. It appears these 16 correspondence course points are already reflected in her retirement points statement. Therefore, there is an insufficient basis for granting her request.
