Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the second award of the Distinguished Flying Cross (DFC) be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states that he did not receive the second award of the DFC until after he had outprocessed. 3. The applicant provides a copy of his DD Form 214, two DFC certificates, Permanent Orders for his first award of the DFC, and his Officer Record Brief. CONSIDERATION OF EVIDENCE: 1. The applicant’s records show he enlisted in the Regular Army on 14 October 1986. He was appointed as Reserve Warrant Officer of the Army on 28 February 1991. The applicant was retired on 28 February 2007. 2. Item 13 (Decorations, Medals, Badges, Citations and Campaign ribbons Awarded or Authorized” of the applicant’s DD Form 214 lists the award of the DFC. 3. U.S. Total Army Personnel Command (now Human Resources Command) (HRC) Permanent Orders Number 031-06 dated 31 January 2002 and certificate show that the applicant was awarded the DFC for extraordinary achievement while participating in aerial flight on 19 October 2001. 4. The applicant also provided a certificate dated 12 December 2006 that awarded him the DFC for heroism while participating in aerial flight in Afghanistan on 10 July 2006. However, the applicant’s records did not contain orders to verify this award. 5. On 5 December 2007 verification of the award of the DFC was obtained from the Awards Branch, HRC. The Awards Branch verified that HRC issued the order that awarded the applicant the DFC dated 12 December 2006. Since the award was classified, HRC could not provide a copy of the permanent orders authorizing the award. However, the HRC official verified the applicant’s entitlement to the DFC (2nd Award) 6. Army Regulation 600-8-22 (Military Awards) provides that the Distinguished Flying Cross is awarded to any person who, while serving in any capacity with the Army of the United States, distinguished himself or herself by heroism or extraordinary achievement while participating in aerial flight. The performance of the act of heroism must be evidenced by voluntary action above and beyond the call of duty. The extraordinary achievement must have resulted in an accomplishment so exceptional and outstanding as to clearly set the individual apart from his or her comrades or from other persons in similar circumstances. Awards will be made only to recognize single acts of heroism or extraordinary achievement and will not be made in recognition of sustained operational activities against an armed enemy. For each succeeding act or period of meritorious service or achievement that justifies the award of a decoration, an oak leaf cluster or numeral device will be awarded. DISCUSSION AND CONCLUSIONS: The applicant’s certificate and HRC verification of the issuance of orders authoring the second award of the DFC is sufficient evidence to correct his records to show this award.
